B PLAN TERMS & CONDITIONS OF SERVICE
SUMMARY:
* We are a private & secure social network of positive minded people. Here, your privacy is highly respected on all levels. This website runs on a secure server protected on all possible levels with the world's most efficient and most expensive protection tools available.
* We do NOT analyse your data or content, including posts, messages or any personal behaviour on the website;
. We do NOT give your personal data or any analysis of your personal data to a third party (like advertizers);
. Your content stay your content; we do NOT require to provides us the rights to use them outside this social network.
* We expect you to share information and share positivity; otherwise we may ban you.
* To sustain our website and protection system we need a tiny contribution from you in a form of a monthly fee.

We build technologies and services that enable people to connect with each other, build communities and grow businesses. These Terms of Service (the "Terms") govern your use of the brand B Plan and B Plan mobile applications, services, technologies, and software we offer (the SPSG Products or Products), except where we expressly state that separate terms (and not these) apply. These Products (SPSG Products or Products) are provided by Sustainable Private Societies’ Guardian s.r.o. (also referred here as SPSG, SPSG s.r.o).
We charge you to use B Plan or the other products and services covered by these Terms - unless we state otherwise – so that we can avoid businesses, organisations and other persons pay us to show you ads for their products and services. Our products and services enable you to connect with your friends and communities. We do not personalise content and we do not show ads that we think may be relevant to you and your interests. You acknowledge that by using or registering to our Products. We do not use your personal data to help determine which personalised ads to show you. When we show advertisement to support our partners, we show it to every user, no matter their activity or preferences they show in the Products.
We don't sell your personal data to advertisers, and we don't share information that directly identifies you (such as your name, email address or other contact information) with advertisers. Advertisers can not tell us things such as the kind of audience that they want to see their ads, and we do not show those ads to people who may be interested, but we show it for all. We do not provide advertisers with reports about the performance of their ads that help them understand how people are interacting with their content.
Our Privacy Policy explains how we collect and use your personal data. You can also go to your Profile Settings pages of the relevant SPSG Product at any time to review your data.
1. The services we provide
Our mission is to give people the power to build community and bring the world closer together in a private and secure manner. To help advance this mission, we provide the products and services described below to you:

Provide a community experience for you and your community: Your experience on B Plan is just like anyone else's: from the Posts, Stories, events, ads and other content that you see in B Plan News Feed or our video platform to the B Plan Pages that you follow and other features you might use, such as B Plan Marketplace and search. For example, we do not collect data about the connections you make, the choices and settings you select and what you share and do on and off our Products to personalise your experience.

Connect you with people and organisations that you care about: We provide you the opportunity to find and connect with people, groups, businesses, organisations and others that matter to you across the SPSG Products you use. At the same time we do not use data to make suggestions for you and others – for example, groups to join, events to attend, B Plan Pages to follow or send a message to, shows to watch and people you may want to become friends with. We do not bother you with that, you have the right to search and select them for yourself. Stronger ties made on our private and secure platform make for better communities, and we believe that our services are most useful when people are connected to people, groups and organisations that they willinly choose to care about, without any intentional influences from a computer/ software system. We prefer human bonds to be established between humans and we consider our system to be a supporter of that.

Empower you to express yourself and communicate about what matters to you and your community: There are many ways to express yourself on B Plan to communicate with friends, family and others about what matters to you – for example, sharing updates about yoursel and your community, photos, videos and stories across the SPSG Products (consistent with your settings), sending messages/ chats or making voice or video calls to a friend or several people, creating events or groups, or adding content to your profile, as well as providing opportunities for others to engage with your content.

Help you discover content, products and services that may interest you and your community: We do not show you personalised ads, offers and other sponsored or commercial content in order to not to influence you in the process of searching and discovering content, products and services that are offered by the many businesses and organisations that use B Plan and other SPSG Products.

Promote the safety, security and integrity of our services, combat harmful conduct and keep our community of users safe: People will only build community on SPSG Products if they feel safe and secure. We work hard to maintain the security (including the availability, authenticity, integrity and confidentiality) of our Products and services. We pay for dedicated teams around the world, work with external service providers, partners and other relevant entities, and develop advanced technical systems to detect potential misuse of our Products, harmful conduct towards others and situations where we may be able to help support or protect our community, including to respond to user reports of potentially violating content. If we learn of content or conduct like this, we will take appropriate action that may include notifying you, offering help, removing content, removing or restricting access to certain features, disabling an account. Anyway, not as some other social networks, we will not contact law enforcement. We share data with other SPSG departments when we detect misuse or harmful conduct by someone using one of our Products or to help keep SPSG Products, users and the community safe. For example, we share information with SPSG departments that provide financial products and services to help them promote safety, security and integrity and comply with applicable law. SPSG may access, preserve, use and share any information it collects about you where it has a good faith belief that it is required or permitted by law to do so. This is needed for the system and the database to operate. Apart from that we do not analyze your actions within the PSP products. For more information, please review our Privacy Policy.

Use and develop advanced technologies to provide safe and functional services for everyone: We use and develop advanced technologies and we develop automated systems to improve our ability to protect our community and our Products. We use server protection and data protection systems that safeguard and secure your data.

Research ways to make our services better: We engage in research to develop, test and improve our Products. This includes analysing only the server data users generate (such as processor and RAM requirements, bandwidth requirenments, storage capacity requirenments), and understanding how people use our Products. Our Privacy Policy explains how we use data to support this research for the purposes of developing and improving our services.

Provide consistent and seamless experiences across the SPSG Company Products: Our Products help you find and connect with people, groups, businesses, organisations and others that are important to you. We design our systems so that your experience is consistent and seamless across the different SPSG Company Products that you use. For example, the same people and groups you are connected with and the same messages appear in the mobile phone applications as in your web application.

Ensuring access to our services: To operate our global services and enable you to connect with people around the world, we need to transfer, store and distribute content and data to our data centres, partners, service providers, vendors and systems around the world, including outside your country of residence. The use of this global infrastructure is necessary and essential to provide our services. This infrastructure may be owned, operated or controlled by SPSG s.r.o., its affiliates or its system development and administration partners.
2. How our services are funded
For paying to use B Plan and the other products and services we offer, by using the SPSG Products covered by these Terms, we do not have to show you personalised ads and other commercial and sponsored content that business and organisations pay us to promote on and off the SPSG Company Products. We do not use your personal data, such as information about your activity and interests, to show you personalised ads and sponsored content.
Protecting people's privacy is central to how we've designed our ads system. This means that we can show you relevant and useful ads that are for all – and thereby seen by all -, without telling advertisers who you are. We don't sell your personal data. Advertisers can not tell us things such as their business goal, and the kind of audience that they want to see their ads (for example, people between the ages of 18-35 who like cycling). We only way we show their ad is to show it to everyone.
We also provide advertisers with reports about the performance of their ads to help them understand how people are interacting with their content on and off SPSG Products. For example, we do not provide general demographic and interest information to advertisers, such as the fact that women between the ages of 25 and 34 who live in Madrid and like software engineering have seen an ad. We don't share information that directly identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are).
We do not collect and use your personal data in order to avoid providind targeted services for advertizers. You can learn about how treat and protect your data in our Privacy Policy.
3. Your commitments to B Plan and our community
We provide these services to you and others to help advance our mission. In exchange, we need you to make the following commitments:

Who can use B Plan
When people stand behind their opinions and actions, our community is safer and more accountable. For this reason, you must:-
Provide for your account the same name that you use in everyday life.

Provide accurate information about yourself;

Only create one account (your own) and use it for personal purposes.

Not share your password, give access to your B Plan account to others or transfer your account to anyone else (without our permission).
We try to make B Plan broadly available to everyone, but you cannot use B Plan if:

You are under 13 years old.

You are a convicted sex offender.

You have to keep the Community Standards (below)

You are part of the network of any secret societies that promote egotism, anger, revenge, pride; or promote the supremacy of worldy wealth; or promote any non-positive physical/ spiritual/ or mental entities or connected teachings; or those organizations which previously or currently practice or perform a fire-, or any kind of offering/ sacraficing of living beings to satisfy their believes; or you are part of any organisations that create preferences about groups of people that is based on their bloodlines or genetics; or you are a part of an organisation or any level of of sub-organization that promote or enhance the establishment of a one world government.

We've previously disabled your account for breaches of our Terms, the Community Standards, or terms and policies that apply to your use of B Plan. If we disable your account for a violation of our Terms, the Community Standards or other terms and policies, you agree not to create another account without our permission. Receiving permission to create a new account is provided at our sole discretion, and does not mean or imply that the disciplinary action was wrong or without cause.

You are prohibited from receiving our products, services or software under applicable laws.

Community Standards
Every day, people use B Plan to share their experiences, connect with friends and family, and build communities. It’s a service for a lot of people to freely express themselves across countries and cultures and in dozens of languages.SPSG recognizes how important it is for B Plan Private & Secure Social Network to be a place where people feel empowered to communicate, and we take our role seriously in keeping abuse off the service. That’s why we developed standards for what is and isn’t allowed on B Plan.
These standards are based on universal values. To ensure everyone’s voice is valued, we take great care to create standards that can harmonize different views and beliefs.
We basically want people to feel home using SPSG Products, therefore we formulated the Community standards, the bridging of which or conducting a behaviour that is not according to it in B Plan Products cause banning the user from the Products.

We accept only the positive expressions or speech of any value systems you carry

Let us bring forward few suggestions of behaviour:

If you are mainly a family type, promote the collective strength of the family and think about and share here about how we can enhance a bigger family like our nation or the population of Earth or the Universe. Remember, a family is as good as its members, so allow and your family members to learn more or get better than you did and support them in this process.

If you are a fighter type show your power of being a positive hero of your community, protect and help the week who need it. Remember, small dogs bark, big dogs don’t need to.

If you are a law & order type who stands up for the bigger truth against bad, allow others to give you feedback and do not build a strickt hierarchy. Remember, good and bad are just two sides of the same coin.

If you are a scientist or a money-maker type support others and share your knowledge so that they reach to your level, as well. Remember to be generous, share your thoughts and wealth for many because it comes back to you multiplied.

If you are a social-, love oriented or eco/bio man, work together with the law&order types so that they provide a good basis for your high flight. Remember to ensure the financial means before you move out from the society with a big heart, and learn that real love is, when you see that everyone is needed in their certain place to add up the whole picture. None of the previous levels you experience are bad, but they all have their functions. Accept them, because you can with your limitless love. Create a system in which everyone finds their right place according to their mindset.

I you are a person who organises big system and coordinate lots of people accoring to their capacities and talent, be keen on building only positive structures. Also, learn to simplify things. Grasp the meaning with one sentence or one word and make it easier for others to get to the level they aim to. Remember to think in universalities, like love, truth, cleanness and so on, and open up your mind to the values that drive people and so, drive processes.

If you think in universal values or the laws of the universe, see, that they refer on all beings. Thus, it is not you who performs them, but these universal value shine through great vessels that let them perform their pure activities. Just be a robot of a universal program. Remember, that this program shall not only be applied in your own community, but as being universal, in the Univers. Remember not to be afraid of imagining a brigher future or higher vibration mindset in any parts of the universe, that can be achived by you as a tool.

I you initiate universal processes or create universal structures that support them, consider, that it is only the good vibration that counts on the level of appereance, on the level of beings. Eperiencing and considering bad as just a vector in space that is just the other direction of good works only on the non-physical and non-energetical level, on the level of nake awareness. So when it about our own world we live in, keep in mind enhancing positive.

If you had this all, consider that all movement has space nature. It appears, plays around and dissapears in space. The physical, the energetical level and thoughts and feelings have this nature as well. So, do not take them serious. Let them go. Every appereance and all perceptions are just an illusory movements in space. So, relax and lay back with your mind enjoying Disneyland and do positive with your thoughts, speech, energies and body.

Please keep in mind that if you do not keep the Community Standards, we can ban you from the Products without paying back any parts/ any amounts of your subscription fee – including the remaining fee of your subscription period -. We are not even obliged to warn you previously. We are not obliged to communicate with you afterwards as well, thus, we do not have to explain our exact reasons of banning your account.

What you can share and do on SPSG Products
We want people to use SPSG Products to express themselves and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of our community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):-
You may not use our Products to do or share anything:

That breaches these Terms, the above Community Standards and other terms and policies that apply to your use of our Products.

That is unlawful, misleading or fraudulent (or assists someone else in using our Products in such a way).
-
That infringes or violates someone else's rights, including their intellectual property rights (such as by infringing another's copyright or trademark, or distributing or selling counterfeit or pirated goods), unless an exception or limitation applies under applicable law.

You may not upload viruses or malicious code, use the services to send spam or do anything else that could disable, overburden, interfere with or impair the proper working, integrity, operation or appearance of our services, systems or Products.

You may not access or collect data from our Products using automated means (without our prior permission) or attempt to access data that you do not have permission to access. We also reserve all of our rights against text and data mining.

You may not proxy, request or collect Product usernames or passwords, or misappropriate access tokens.

You may not sell, license or purchase any data obtained from us or our services.
-
You may not misuse any reporting, flagging, dispute or appeals channel, such as by making fraudulent, duplicative or groundless reports or appeals.
We can remove or block content that is in breach of these provisions. We can also suspend or disable your account for conduct that violates these provisions, as provided in Section 4.2.
If we remove content that you have shared for violation of the Community Standards, we'll let you know and explain any options that you have to request another review, unless you seriously or repeatedly violate these Terms or if doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons. For information on account suspension or termination, see Section 4.2 below.
To help support our community, we encourage you to report content or conduct that you believe breaches your rights (including intellectual property rights) or our terms and policies if this feature exists in your jurisdiction.
We can also remove or restrict access to content, features, services or information if we determine that doing so is reasonably necessary to avoid or mitigate misuse of our services or adverse legal or regulatory impacts to SPSG.

The permissions you give us
We need certain permissions from you to provide our services:-
Permission to use content that you create and share: Some content that you share or upload, such as photos or videos, may be protected by intellectual property laws.
You retain ownership of the intellectual property rights (things such as copyright or trademarks) in any such content that you create and share on B Plan and other SPSG Company Products that you use. Nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want.
However, to provide our services we need you to give us some legal permissions (known as a "License") to use this content. This is solely for the purposes of providing and improving our Products and services as described in Section 1 above.
Specifically, when you share, post or upload content that is covered by intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free and worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you share a photo on B Plan, you give us permission to store, copy and share it with others (again, consistent with your settings) such as SPSG Products or service providers that support those products and services. This licence will end when your content is deleted from our systems.
You can delete individual content that you share, post and upload at any time. In addition, all content posted to your personal account will be deleted if you delete your account (from your Personal Profile menu). Account deletion does not automatically delete content that you post as an admin of a Page or content that you create collectively with other users, such as photos in Shared Albums that may continue to be visible to other album members.
After you delete your account, your contents are immediately and automatically become deleted. If you send content to the bin, the deletion process is the same. While the deletion process for such content is being undertaken, the content is no longer visible to other users. After the content is deleted, it may take us up to ninety days to remove it from server backups and disaster recovery systems.
Content will not be deleted within ninety days of the account deletion or content deletion process beginning in the following situations:

where your content has been used by others in accordance with this licence and they have not deleted it (in which case this licence will continue to apply until that content is deleted);
-
where deletion within ninety days is not possible due to technical limitations of our systems, in which case, we will complete the deletion as soon as technically feasible; or
-
Where immediate deletion would restrict our ability to:
-
investigate or identify illegal activity or breaches of our Terms and Policies (for example, to identify or investigate misuse of our Products or systems);
-
protect the safety, integrity and security of our Products, systems, services, our employees and users, and to defend ourselves;
-
comply with legal obligations for the preservation of evidence, including data that SPSG Companies providing financial products and services preserve to comply with any record-keeping obligations required by law; or
-
comply with a request of a judicial or administrative authority, law enforcement or a government agency;
-
in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis).
In each of the above cases, this licence will continue until the content has been fully deleted.

Permission to use your name, profile picture and information about your actions each other: For example, we may show only to your friends that you are interested in an advertised event or have liked a B Plan Page created by a brand that has paid us to display its ads on B Plan. These internal activity increasing information and content such as this can only be seen by people who have your permission to see the actions that you've taken on SPSG Products.

Permission to update software that you use or download: If you download or use our software, you give us permission to download and install updates to the software where available.

Limits on using our intellectual property
If you use content covered by intellectual property rights that we have and make available in our Products (for example, images, designs, videos or sounds we provide that you add to content you create or share on B Plan), we retain all rights to that content (but not yours). You can only use our copyrights or trademarks (or any similar marks) as expressly permitted by our Brand Usage Guideline (that can be requested from the Administrator through the Contact form) or with our prior written permission. You must obtain our written permission (or permission under an open-source licence) to modify, translate, create derivative works of, decompile or reverse-engineer our products or their components, or otherwise attempt to extract source code from us, unless an exception or limitation applies under applicable law or your conduct results banning.
4. Additional provisions

Updating our Terms
We work constantly to improve our services and develop new features to make our Products better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices to promote a safe and secure experience on our Products and services, and/or to comply with applicable law. We will only make any changes if the provisions are no longer appropriate or if they are incomplete, and only if the changes are reasonable and take due account of your interests, or if the changes are required for safety and security purposes or to comply with applicable law.We will notify you (for example, by email or through our Products) at least thirty days before we make changes to these Terms and give you an opportunity to review them before they go into effect, unless the changes are required by law. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products.
We hope that you will continue using our Products, but if you do not agree to our updated Terms and no longer want to be a part of the SPSG community, you can delete your account at any time.

Account suspension or termination
We want B Plan to be a place where people feel welcome and safe to express themselves and share their thoughts and ideas.If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies, including, in particular, the Community Standards, we may suspend or permanently disable your access to SPSG Company Products, and we may permanently disable or delete your account. We may also disable or delete your account if you repeatedly infringe other people's intellectual property rights or where we are required to do so for legal reasons.
We may disable or delete your account if, after registration, your account is not confirmed, your account is unused and remains inactive for an extended period of time or if we detect that someone may have used it without your permission and we are unable to confirm your ownership of the account.
Where we take such action, we'll let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.
You may contact us through the Contact form or the Support email of support @ b-plan.club if your account has been disabled and how to contact us if you think that we have disabled your account by mistake.
If you delete or we disable or delete your account, these Terms shall terminate as an agreement between you and us, but the following provisions will remain in place: 3.3.1, 4.2-4.5.

Account deletion due to expiry
Another aspect from which your account may be deleted is due to subscription renewal exiry periods. To understand the reason, we shall share the information, that the registration of each and every new user into the B-Plan system requires new server resources/capacities to add. This happens automatically. This costs money for us, as hard disk storage capacity (of videos, pictures) and server memory capacity of using a server has a user-count dependent cost. This cost is covered by your subscription fee, as an average fee we calculated to cover the total operating costs. In case you do not subscribe to any of the subscription packages (whether you tried the system with the 14-days free trial period or not) we may delete your account in order to save system resources. This happens on the fourtieth day after the 14-days trial or the fourtieth day after the ending day of your last subscription month or the fourtieth day of your day of passive registration (without choosing the fourteen days trial or a subscription package). We send you an email on the fourteenth day of your trial, on the thirtieth day that is spent without subscription, the thirty-ninth day without subsription and on the 40th day without subscription. On the fourtieth day we delete your account. You will not be able to log in anymore, and we will not be able to recover your account. Nevertheless, our system still keeps and stores your data for ninety days due to the reasons eplained in the above section 4.2. -
Limits on liability
Nothing in these Terms is intended to exclude or limit our liability for death, personal injury or fraudulent misrepresentation caused by our negligence, or to affect your statutory rights.We will exercise professional diligence in providing our Products and services to you and in keeping a safe, secure and error-free environment. Provided that we have acted with professional diligence, we do not accept responsibility for losses not caused by our breach of these Terms or otherwise by our acts; losses that are not reasonably foreseeable by you and us at the time of entering into these Terms; and events beyond our reasonable control.

Disputes
You may report any issue with your use of B Plan service by reporting it to us as by friending and writing to the B Plan Support user on b-plan.club. If your claim is not resolved, you may kindly consider the following.If a claim or dispute arises out of or relates to your use of the SPSG Products as a consumer, both you and us agree that you may resolve your individual claim or dispute against us, and we may resolve our claim or dispute against you in any competent Private Court in the country of your main residence that has jurisdiction over your claim or dispute, and the laws of that country will apply without regard to conflict of law provisions.
If a claim or dispute arises between us that relates to use of the SPSG Products in any other capacity, including, but not limited to, access or use of the SPSG Products for a business or commercial purpose, or that an entity brings on your behalf, you agree that any such claim or dispute must be resolved in a competent Private Court and Private Law will apply to such claim or dispute without regard to conflict of law provisions.

Other

These Terms make up the entire agreement between you and SPSG s.r.o. regarding your use of our Products. They supersede any prior agreements.

Some of the Products that we offer are also governed by supplemental Terms. If you use any of these Products, you will be provided with an opportunity to agree to supplemental Terms that will become part of our agreement with you. For instance, if you access or use our Products for commercial or business purposes, such as buying ads, selling products, developing apps, managing a group or Page for your business, or using our measurement services, you must agree to our Commercial Terms (below). If you post or share content containing music, you must comply with our Music Guidelines (below). To the extent that any supplemental Terms conflict with these Terms, the supplemental Terms shall govern to the extent of the conflict.

If any portion of these Terms is found to be unenforceable, the unenforceable portion will be deemed amended to the minimum extent necessary to make it enforceable, and if it can't be made enforceable, then it will be severed and the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.

You will not transfer any of your rights or obligations under these Terms to anyone else without our consent.

You may designate a person (Called a legacy contact) to manage your account if it is memorialised. If you enable it in your settings, only your legacy contact or a person who you have identified in a valid will or similar legal document expressing clear consent to disclose your content to that person upon death or incapacity will be able to seek limited disclosure of information from your account after it is memorialised.

These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition or sale of assets, or by operation of law or otherwise.

We may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life).

We always appreciate your feedback and other suggestions about our products and services. But we may use feedback and other suggestions without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

If the ownership or control of all or part of our Products or their assets changes, this could result in a transfer of your information to the new owner.

5. Other Terms and Policies that may apply to you

Community Standards (higher up, within this document): These guidelines outline our standards regarding the content that you post to B Plan and your activity on B Plan and other SPSG Products.

European Electronic Communications Code (below): regulates electronic communication rules in Europe.

Commercial Terms (below): These Terms apply if you also access or use our Products for any commercial or business purpose, including advertising, operating an app on our Platform, using our measurement services, managing a group or a Page for a business, or selling goods or services.

Community Payment Terms (below): These Terms apply to payments made on or through SPSG Products.

EUROPEAN ELECTRONIC COMMUNICATIONS CODE
for messaging, voice and video calling services included in SPSG s.r.o (further on referenced as SPS) Products as B Plan Private & Social Network (further on referenced as B Plan).
Effective as of 21 December 2020
The European Electronic Communications Code (Directive (EU) 2018/1972) (the "EECC") requires us to provide applicable users with the following information about the electronic communication service that we provide as part of B Plan's messaging services, including all communication by text, voice and video. This information supplements the terms of service for those services. Applicable users include microenterprises or small enterprises or not-for-profit organisations, unless they have explicitly agreed to waive all or parts of those provisions.
For the purposes of your documentation, future reference and unchanged reproduction, you may download or print a copy of this document.
Our quality of service
We work hard to provide the best service we can. However, we cannot guarantee any minimum levels of quality of service and make no guarantees that our messaging services will always function without disruptions, delay or errors. A number of factors beyond our control may also affect your experience in using our messaging services, and may result in the disruption of your communication with other users, including but not limited to: your local network, firewall, your Internet service provider, the public Internet and power supply.
Price
We do not charge for using our messaging services, as this is the only way for us to finance the costs of the secure server and security services connected to the system. We charge a monthly fee that amounts circa 1 USD and varies based on the package you choose – 1 month, 3 months, 6 months or 12 months payment -. The higher the subscription period, the lower the price. You may also choose to try the services we provide free of charge for 14 days, and only choose a subscription package if you are satisfied with it.
All users of our messaging services are responsible for mobile network data plans, Internet access fees, and other fees and taxes associated with use of our services.
Duration
Our users can terminate their relationship with our service at any time for any reason by deleting their account. We may modify, suspend or terminate your access to or use of our messaging services for the reasons described further below in this Terms of Service.
The security we provide on our messaging services
We work to protect the safety, security and integrity of our messaging services by appropriately dealing with abusive people and activity violating our Terms of Service. We work to prohibit misuse of our service, including harmful conduct towards others. We operate systems to improve our ability to detect incidents, threats or vulnerabilities that may harm the security of our service. If we learn of activity like this, we will take appropriate action, such as removing that activity or contacting law enforcement.
We particularily take steps not to provide data from within our social network to search engines.
Data provided by you
When you sign up for our messaging service, we ask you to provide your name, date of birth (so that we may provide the right B Plan experience for your age), gender (optional), email address or mobile number. You may provide a username and a password and optionally choose from user categories.
The B Plan Data Policy includes information on the personal data that is collected in the context of providing the B Plan messaging / chat services.
Features for end users with disabilities
Our messaging services are compatible with the B Plan network’s visibility setting of Dark Mode, that provides a significant (black and white) contrast for the disabled.

You can take legal action against us for any claim that arises out of, or relates to, our messaging or chatting services. For information on which governing law and venue applies to your claim, please refer to the Disputes section of the B Plan Terms of Service.
Lastly, you may be entitled to refer disputes in relation to matters covered by the EECC to an independent body for dispute resolution appointed in your country. You cannot access emergency services through our messaging/ chat services
There are important differences between our services and your mobile phone and a fixed-line telephone and SMS services. Our services do not provide access to emergency services or emergency services providers, including the police, fire departments or hospitals, or otherwise connect to public safety answering points. You should ensure that you can contact your relevant emergency services providers through a mobile phone, a fixed-line telephone or another service.

B PLAN COMMERCIAL TERMS ("Commercial Terms")
These Commercial Terms apply to access or use of the SPSG Products (or "Products"), for a business or commercial purpose (except where we state that separate terms, and not these Commercial Terms, apply to such access or use of a B Plan Product). Business or commercial purposes include using ads, selling products, developing apps, managing a Page, managing a Group for business purposes or using our measurement services regardless of the entity type.
You agree that you will ensure that any third party on whose behalf you access or use any SPSG Product for any business or commercial purpose will abide by the applicable terms of use, including these Commercial Terms, the SPSG Terms of Service ("Terms"), and any applicable supplemental terms, and you represent and warrant that you have the authority to bind that third party to such terms.
As more fully described below, if you reside in the Czech Republic or your business is located in the Czech Republic, these Commercial Terms require the resolution of most disputes between you and us by binding arbitration on an individual basis; class actions and jury trials are not permitted.

Licences: As described in "The permissions you give us" section in our Terms, you grant us a social-network-internal licence to content that is covered by intellectual property rights (e.g. photos or videos) that you share, post or upload on or in connection with our SPSG Products. For any access or use of the SPSG Products, that licence applies to content that you or someone on your behalf (such as your agency or your service provider that manages your Page content for you) makes available on or in connection with any SPSG Product. You will also ensure that you own or have secured all rights necessary to grant the licences and rights that you (or someone on your behalf) grant to us under the Commercial Terms and any applicable supplemental terms, including permission to display, distribute and deliver your content within the SPSG Products.

Compliance with law: You represent and warrant that your access or use of the SPSG Products for business or commercial purposes complies with all applicable laws, rules, and regulations. You further represent that you will restrict access to your content and apps in accordance with all applicable laws, rules and regulations, including geo-filtering or age-gating access or warnings where required. In addition to and without limiting the requirements about who can use the SPSG Products under our Terms, if you are located in a country that is subject to embargo under the laws of the Czech Republic (or under similar laws applicable to you) you may not engage in commercial activities on the SPSG Products unless authorised by applicable laws. If you are on the US Treasury Department's list of Specially Designated Nationals (or an equivalent list), you may not engage in commercial or business activities on the SPSG Products (such as advertising or payments). You are also unable to access or use the SPSG Products if you are prohibited from receiving products, services or software under applicable law.

Data restrictions: You may not send us information prohibited by the supplemental terms or policies. In addition, you may not send to us, or use SPSG Products to collect from people, information that: (i) you know or reasonably should know is from or about children under the age of 13; or (ii) includes health, financial, biometrics or other categories of similarly sensitive information (including any information defined as sensitive under applicable law); except in cases where (a) the terms for that SPSG Product specifically allow it or (b) you are sending financial information for the express purpose of effecting a financial transaction either with us or as enabled by a SPSG Product.

Limits on liability: In addition to and without limiting the scope of the "Limits on liability" section in our Terms, you agree that we are not responsible for the actions, services, content or data of third parties and you release us, our directors, officers, employees and agents from any claims and damages, known or unknown, arising out of or in any way connected with any claim that you have against any such third parties.
If you are a California resident, you agree to waive California Civil Code Section 1542, which says:
A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOUR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER, MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.
Our aggregate liability arising out of or relating to any access or use of the SPSG Products, the Terms (for any access or use of the SPSG Products for business or commercial purposes), or these Commercial Terms will not exceed the greater of one hundred dollars (USD 100) or the amount that you have paid us in the past twelve months. -
Disputes:

Third-party claims: If anyone brings a claim, cause of action or dispute against us related to your services, actions, content or information on B Plan or other SPSG Products or your use of any SPSG Products, you agree to indemnify and hold us harmless from and against any damages, losses and expenses of any kind (including reasonable legal fees and costs) related to any such claim, cause of action or dispute.

Commercial claims: Sections 5.c and 5.d below apply to any claim, cause of action or dispute that arises out of or relates to any access or use of the SPSG Products for business or commercial purposes ("Commercial Claim") between you and SPS.

CZ Commercial Claims: If you reside in the Czech Republic or your business is located in the Czech Republic :

You agree to arbitrate Commercial Claims between you and SPSG sro, Inc. This provision does not cover any commercial claims relating to breaches of your or our intellectual property rights, including, but not limited to, copyright infringement, patent infringement, trademark infringement, breaches of the Bran Usage Guidelines, breaches of your or our confidential information or trade secrets, or efforts to interfere with our Products or engage with our Products in unauthorised ways (for example, automated ways). If a Commercial Claim between you and SPSG sro is not subject to arbitration, you agree that the claim must be resolved exclusively on a private contract court of our choice, and that you submit to the personal jurisdiction of any of these courts for the purpose of litigating any such claim.

By entering into this arbitration provision, we and you agree that all parties are waiving their respective rights to a trial by a private jury or to participate in a class or representative action. THE PARTIES AGREE THAT EACH MAY BRING COMMERCIAL CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL PROCEEDING. You may bring a Commercial Claim only on your own behalf and cannot seek relief that would affect other parties. If there is a final judicial determination that any particular Commercial Claim (or a request for particular relief) cannot be arbitrated according to the limitations of this Section 5.c, then only that Commercial Claim (or only that request for relief) may be brought in court. All other Commercial Claims (or requests for relief) will remain subject to this Section 5.c. All issues are for an arbitrator to decide, except that only a court may decide issues relating to the scope or enforceability of this arbitration provision or the interpretation of the prohibition of class and representative actions. If any party intends to seek arbitration of a dispute, that party must provide the other party with notice in writing. This notice of dispute to us must be sent to the following address: SPSG sro, PRAHA 10 - Korunní 2569/108, PSČ 10100, Czech Republic. The arbitration will be governed by the European Court of Arbitration (ECA) according to its Commercial Arbitration Rules, as modified by these Commercial Terms, and will be administered by the ECA. If the ECA is unavailable, the parties will agree to another arbitration provider or the court will appoint a substitute. The arbitrator will not be bound by rulings in other arbitrations in which you are not a party. To the fullest extent permitted by applicable law, any evidentiary submissions made in arbitration will be maintained as confidential in the absence of good cause for its disclosure. The arbitrator's award will be maintained as confidential only to the extent necessary to protect either party's trade secrets or proprietary business information or to comply with a legal requirement mandating confidentiality. Each party will be responsible for paying any ECA filing, administrative and arbitrator fees in accordance with ECA Rules, except that we will pay for your filing, administrative and arbitrator fees if your Commercial Claim for damages does not exceed USD 75,000 and is non-frivolous. If you do not wish to be bound by this provision (including its waiver of class and representative claims), you must notify us as set forth below within 30 days of the first acceptance date of any version of these Commercial Terms containing an arbitration provision. Your notice to us under this Section 5.c must be submitted to the address here: SPSG sro, PRAHA 10 - Korunní 2569/108, PSČ 10100, Czech Republic. All Commercial Claims between us, whether subject to arbitration or not, will be governed by California law, excluding California's conflict of laws rules, except to the extent that California law is contrary to or pre-empted by federal law. If a Commercial Claim between you and us is not subject to arbitration, you agree that the claim must be resolved exclusively a private court of our choice, and that you submit to the private jurisdiction of either of these courts for the purpose of litigating any such claim.

Commercial Claims outside the Czech Republic : If you reside outside the Czech Republic or your business is located outside the Czech Republic, you agree that:

Any Commercial Claim between you and SPSG sro, must be resolved exclusively in a private court of our choice, that you submit to the personal jurisdiction of either of that court for the purpose of litigating any such claim.

Without prejudice to the foregoing, you agree that, in our sole discretion, we may also bring any claim we have against you related to efforts to abuse, interfere or engage with our Products in unauthorised ways in the country in which you reside that has jurisdiction over the claim.

Severability: If any provision of this Section 5 is found unenforceable, that provision will be severed and the balance of this Section 5 will remain in full force and effect.

Updates: We may need to update these Commercial Terms from time to time, including to accurately reflect the access or uses of our Products for business or commercial purposes, and so we encourage you to check them regularly for any updates. By continuing any access or use of any SPSG Products for business or commercial purposes after any notice of an update to these Commercial Terms, you agree to be bound by them. Any updates to Section 5 of these Commercial Terms will only apply to disputes that arise after notice of the update takes place. If you do not agree to the updated terms, please stop all access or use of our Products for business or commercial purposes.

Conflicts and supplemental terms: If there is a conflict between these Commercial Terms and the Terms, these Commercial Terms will govern with respect to your access and use of the SPSG Products for business or commercial purposes to the extent of the conflict. Supplemental terms and policies may also apply to your use of certain SPSG Products. To the extent that those supplemental terms conflict with the Commercial Terms, the supplemental terms will govern with respect to your use of those SPSG Products to the extent of the conflict.

If any portion of these Commercial Terms are found to be unenforceable, then (except as otherwise provided) that portion will be severed and the remaining portion will remain in full force and effect.

If we fail to enforce any of these Commercial Terms, it will not be considered a waiver.

Except as permitted in Section 6, any amendment to or waiver of these Commercial Terms must be made in writing and signed by us.

You will not transfer any of your rights or obligations under these Commercial Terms to anyone else without our consent.

These Commercial Terms do not confer any third-party beneficiary rights.

We offer tools to provide transparency and controls to our users about the B Plan experience. Information about you and your use of SPSG Products for commercial or business purposes will not be included in these tools.

You consent that we may disclose your advertising content and B Plan Page posts ("Commercial Content"), and all information associated with such Commercial Content, including information associated with the delivery of that Commercial Content, in response to a valid legal process related to an electoral matter or to a governmental entity or body if SPSG believes that disclosure would assist in a lawful investigation.

Please note that our retention policies for Commercial Content may differ from those set forth in the Terms. We retain Commercial Content as necessary to provide our services to users, for internal record keeping and for product improvement and safety purposes.

All of our rights and obligations under these Commercial Terms are freely assignable by us in connection with a merger, acquisition or sale of assets, or by operation of law or otherwise.

Nothing in these Commercial Terms or any applicable supplemental terms will prevent us from complying with the law.

We reserve all rights not expressly granted to you.

Note: For purposes of these Commercial Terms, references in existing terms or agreements to (i) "the Statement of Rights and Responsibilities", "Statement" or "SRR" will now mean that the SPSG Terms or Terms and (ii) "B Plan" (when used to refer to our products and services) or "B Plan Services" or "Services" will now mean SPSG Products.

B PLAN MUSIC GUIDELINES
These supplemental terms apply if you post or share any videos or other content containing music on any SPSG Products.
You are responsible for the content you post
People use our Products to share content with their fans, family and friends. Keep in mind you remain solely responsible for the content that you post, including any music that is featured in that content. Nothing in these terms constitutes any authorization by us with respect to any use of music on any of our Products.
Use of music for commercial or non-personal purposes in particular is prohibited unless you have obtained appropriate licenses. Eligibility for, and participation in, Music Revenue Sharing does not by itself make a video commercial.
You may not use videos on our Products to create a music listening experience
We want your fans, family and friend to be able to enjoy your videos. However, if you use videos on our Products to create a music listening experience for yourself or for others, your videos may be blocked and your page, profile or group may be deleted. This includes live videos.
Unauthorized content may be removed and you take all (including financial) responsibilities for the charges or damages that non-removal may cause
If you post content that contains music owned by someone else, your content may be reviewed by the applicable rights owner and your content may be blocked, muted or removed if your use of that music is not properly authorized. Otherwise, you agree, that you are responsible for any fines or damages the inproper or unlawful use of content causes to SPSG sro, and in this case you take over any fees, fines or charges that may apply on SPSG sro; you agree to take all connected responsibilities on yourself.
The following guidelines can help you plan for your videos:

The greater the density of music in a video, the more likely it may be limited (e.g., blocked, muted)

There should always be a visual component to your video; recorded audio should not be the primary purpose of the video

B PLAN PAYMENT GUIDELINES
1. Making payments
-
Payment credentials. When you make a payment through the B Plan Products, you agree to provide a valid payment credential. When you have successfully added your payment credential, we will allow you to initiate a transaction using the payments features through the B Plan Products.

Pricing. Pay attention to the details of the transaction, because your total price may include taxes, fees and delivery costs, all of which you are responsible for paying.
-
Extra terms. You may be presented with additional terms related to a specific payment before you confirm the transaction (such as delivery terms for tangible goods). Those additional terms will also govern that transaction.
-
Foreign exchange. If your transaction requires a currency exchange, we will use foreign exchange rates provided by one or more external vendors. We aim to upload files from our vendors with the current exchange rates into our system on a daily basis or we simply rely on our payment provider’s exchange rates. However, these processes could be delayed or fail for any number of reasons. If this happens, the foreign exchange rates used will be the ones from the last file received, typically, the ones from the previous day.

Subscriptions. If you purchase a subscription to B Plan, to an app or to a feature within an app, we will bill your payment credential immediately, and then again at the beginning of each subscription period. The following terms apply for subscriptions purchased through payments features through the B Plan Products:

If a free trial period is offered and you do not cancel during the free trial period, you will be billed at the end of the free trial period and at the beginning of each subsequent subscription period.

You can cancel subscriptions at any time on your Account settings page.

If you cancel a subscription, you will still have access to the app or feature that you subscribed to through the end of the subscription period. If an app or feature that you subscribed to becomes unavailable during your subscription, you will not be billed at the beginning of the next subscription period.

No warranties. You acknowledge that any products or services you may purchase are sold by merchants, not by us. WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD ON OR THROUGH THE B PLAN PRODUCTS.
2. Payment methods

Payment credentials. For your convenience, we allow you to fund your transactions using a number of different sources, such as bank cards, and other payment methods.
-
Authority. When you provide a payment credential to us, you confirm that you are permitted to use that payment credential. When you fund a transaction, you authorise us (and our designated payment processor) to charge the full amount to the payment credential that you designate for the transaction. You also authorise us to collect and store that payment credential, along with other related transaction information. We may also use certain payment card updater services, whose availability varies by issuer, to ensure that we have the most up-to-date information about payment credentials that we store.

Authorisation. If you pay by credit or debit card, we may obtain a pre-approval from the issuer of the card for an amount, which may be as high as the full price of your payment. Your card will be charged at the time that you initiate a payment, or shortly thereafter. If you cancel a transaction before completion, this pre-approval may result in those funds not otherwise being immediately available to you.

Failed payments. If your transaction results in an overdraft or other fee from your bank, you alone are responsible for that fee.
-
Incompatibility. You may at some point encounter an app or feature that does not support the payment method you would prefer to use; however, you can select a different type of payment instrument (such as credit or debit card, or else).

Refunds. Due to technical limitations, we are able to provide refunds ONLY by making wire transfer into a bank account. If you make a purchase with boleto and later request a refund for any reason, you MUST have a bank account in order to receive the refund. Bank account information provided when requesting a refund should be the same information on the ad account.

Safety. We may delay or limit the availability of your purchase, for either safety reasons, or to make sure that we possess all relevant information necessary to process the payment and deliver to you what you have paid for.
3. Actions we may take
-
At-will use. We may revoke your eligibility to make payments through the B Plan Products at any time at our sole discretion.

Enquiries. By using payments features through the B Plan Products, you acknowledge and agree that we may make any enquiries that we consider necessary, either directly or through third parties, concerning your identity and creditworthiness.

Our right to cancel. We may cancel any transaction if we believe that the transaction violates these Payments Terms or the Terms & Conditions, or if we believe that doing so may prevent financial loss.

Payment limitations. In order to prevent financial loss to you or to us, we may place a delay on a payment for a period of time, or limit payment credentials for a transaction, or limit your ability to make a payment, or deactivate your account.

Sharing of information. In order to prevent financial loss to you or to us, we may contact your payment credential issuer, law enforcement or affected third parties (including other users) and share details of any payments that you are associated with, if we believe that doing so may prevent financial loss or a violation of law.

4. Disputes and reversals

Customer assistance. Subject to Sections 4.2, 4.3, 4.4, and 4.5 below, we provide various tools in our Support Center (support @ b-plan .club) to assist you in communicating with a third party to resolve a dispute arising from a payment transaction.

No liability for underlying transaction. If you enter into a transaction with a third party and have a dispute over the goods or services that you purchased or over the donation that you made, we have no liability for the goods or services underlying the transaction or for how the third party used your donation. Our only responsibility is to handle your payment transaction. All payments are final unless otherwise required by law. If you order something that becomes unavailable before it can be provided to you, you may request a refund of your payment.

Fraud warning. Use of B Plan Payments to perform fraudulent transactions may result in the loss of funds with no recourse. See Section 6 below for the state specific fraud notices.

Duty to notify us. If you believe that an unauthorised or otherwise problematic transaction has taken place under your account, you agree to notify us immediately, so that we may take action to prevent financial loss. Unless you submit the claim to us within 30 days after the charge, you will have waived, to the fullest extent permitted by law, all claims against us arising out of or otherwise related to the transaction.

Intervention. We may intervene in disputes concerning payments that may arise between you and a developer, but we have no obligation to do so.
-
Technical difficulties. If you experience a technical failure or interruption of service that causes your payment to fail, you may request that your transaction be completed at a later time.
5. Notices and amendments to these Payments Terms

Notice to you. By using payments features through the B Plan Products, you agree that we may communicate with you electronically any important information regarding your payments or your account. We may also provide notices to you by posting them on our website, or by sending them to an email address or street address that you previously provided to us. Website and email notices shall be considered received by you within 24 hours of the time posted or sent; notices by post shall be considered received within three (3) working days of the time sent.

Notice to us. Except as otherwise stated, you must send notices to us relating to payments through the B Plan Products and these Payments Terms by post to: SPSG sro (B Plan), Attn: Legal Department, PRAHA 10 - Korunní 2569/108, PSČ 10100, Czech Republic.

Amendment guidelines. We may update these Payments Terms at any time without notice as we deem necessary to the full extent permitted by law. The Payments Terms in place at the time that you confirm a transaction will govern that transaction.

7. Additional Terms

Terms of Service and conflict of terms. Our Terms of Service ("Terms" or „Terms & Conditions”) apply to your use of payments features through the B Plan Products. In the event of any conflict between these Payments Terms and the Terms, the Payments Terms shall prevail.

Conflict of laws. Some countries may restrict or prohibit your ability to make payments through the B Plan Products. Nothing in these Payments Terms should be read to override or circumvent any such foreign laws.

Courtesy translations. These Payments Terms were written in English (US). To the extent that any translated version of these Payments Terms conflicts with the English version, the English version controls.

Trade sanctions. You must not use payments features through the B Plan Products in connection with activities, individuals or entities that are located in a country or region that is embargoed by the Czech Republic or that would otherwise violate applicable CZ or CZ trade sanctions.

"Us". Without limiting Section 7.1, above, the following are the entities to which "us", "we" or "our" refer: these Payments Terms are between you and B Plan (SPSG sro) (as provided under the Terms).

"B Plan-Processed Payments". As used in these Payments Terms, "B Plan-Processed Payments" refers to payments features where payments are directly facilitated through the B Plan Products by B Plan sro.

B PLAN COMMERCE POLICIES
Overview
Products sold on B Plan, must comply with our Commerce Policies. Additionally, products sold on B Plan must comply with B Plan's Community Standards. Buyers and sellers are also responsible for complying with all applicable laws and regulations. Failure to comply with our policies may result in a variety of consequences, including, but not limited to, removal of listings and other content, rejection of product tags or suspension or termination of access to any or all B Plan commerce surfaces or features. If you repeatedly post content that violates our policies, we may take additional action on your account. We reserve the right to reject, approve or remove any listing for any reason at any time, at our sole discretion.
Steps to take if disapproved
Appeal the decision
If your listing has been rejected for violating our Commerce Policies and you feel that it was a mistake, you can request a review by writing to us through the contact form, or these steps for products in your Catalogue, and we'll take another look.
Prohibited content
Buying or selling of the following is prohibited on B Plan commerce surfaces and features: any product that is prohibited by the laws of your country. You may only sell products that are not prohibited in the buyer’s country. For this action you take full legal and financial responsibility and take over any fees, fines or charges that may be applied on SPSG sro caused by such inproper action.
Community Standards: Commerce listings must not violate our Community Standards.
Adult products: Listings may not promote the buying, selling or use of adult products.
Alcohol: Listings may not promote the buying or selling of alcohol.
Body parts and fluids: Listings may not promote the buying or selling of human body parts or fluids.
Digital media and electronic devices
Listings may not promote the buying or selling of devices that facilitate or encourage streaming digital content in an unauthorised manner or interfering with the functionality of electronic devices.
Discrimination: Listings must comply with all applicable laws prohibiting discrimination. This includes but is not limited to discrimination for housing listings.
Documents, currency and financial instruments
Listings may not promote the buying or selling of real or fake documents, currency, financial instruments and virtual currency.
Gambling: Listings may not promote the buying, selling or facilitation of online gambling for money or money's worth, including digital currencies. Online gambling includes gaming, betting, lotteries, raffles, casino, fantasy sports, bingo, poker and sweepstakes in an online environment.
Hazardous goods and materials: Listings may not promote the buying or selling of hazardous materials and substances.
Human exploitation and sexual services: Listings may not promote any form of human trafficking, prostitution, escort or sexual services.
Ingestible supplements: Listings may not promote the buying or selling of ingestible supplements.
Jobs
Misleading, violent or hateful: Listings may not contain misleading, violent or hateful products and offers.
No item for sale: Listings may not promote news, humour or other content that does not offer any product for sale.
Prescription products, drugs and drug paraphernalia: Listings may not promote the buying or selling of drugs, drug paraphernalia or prescription products.
Recalled products: Listings may not promote the buying or selling of recalled products.
Sexually positioned products: Listings may not position products or services in a sexually suggestive manner.
Stolen goods: Listings may not promote the buying or selling of items that have been stolen.
Subscriptions and digital products: Listings may not promote the buying or selling of downloadable digital content, digital subscriptions or digital accounts.
Third-party infringement: Listings may not contain content that infringes upon or violates the intellectual property rights of any third party, including copyright or trademark. This includes, but is not limited to, the promotion or sale of counterfeits, such as goods that copy the trademark (name or logo) and/or distinctive features of another company's products to imitate a genuine product.
Tobacco products and related paraphernalia: Listings may not promote the buying or selling of tobacco products or tobacco paraphernalia.
Weapons, ammunition and explosives: Listings may not promote the buying or selling of weapons, ammunition and explosives.
Value papers: The buying and selling of value papers or vouchers is restricted.

PAGES, GROUPS & EVENTS POLICY
Overview
1. Understanding Our Policies
The following terms, as well as our Data Policy, Community Standards, and Terms of Service, apply to all creators and administrators of Pages, Groups and Events on B Plan. You are responsible for ensuring that your Page, Group, or Event complies with all applicable laws, statutes, and regulations.
2. General Policies for Pages, Groups, and Events
Prohibited Business Practices:
Pages, Groups, and Events must not promote products, services, schemes or offers using deceptive or misleading business practices, including those intended to scam people out of money or personal information.
Impersonation:
Pages, Groups, and Events must not impersonate or falsely represent a brand, entity, or public figure. Where a Page, Group, or Event is being used to express support for or interest in a brand, entity, or public figure, it must make clear in the name or description that it is not an official representation.
Gambling:
Pages, Groups, and Events must not promote online gambling, or gaming where anything of monetary value (including digital currencies) is required to play and anything of monetary value forms part of the prize, without our prior written permission. Common types of gambling or gaming activities which may require permission include betting, lotteries, raffles, casino, fantasy sports, bingo, poker, skill game tournaments and sweepstakes.
Inaccurately Tagged Content:
Pages, Groups, and Events must not inaccurately tag content or encourage users to inaccurately tag content.
Incentivization:
Pages, Groups, and Events must not incentivize people to misuse B Plan features or functionality.
Drug and Alcohol Addiction Treatment
Pages, Groups, and Events must not promote drug and alcohol addiction treatment centers that are misleading, engaging in practices that are harmful to patients, or otherwise violating applicable laws.
3. Platform Policy
Apps on Pages, Groups, or Events must comply with the Developer Policies and Platform Terms.
4. Promotions on Pages, Groups, and Events
Communicating a Promotion:
If you use B Plan to communicate or administer a promotion (ex: a contest or sweepstakes), you are responsible for the lawful operation of that promotion, including: The official rules; Offer terms and eligibility requirements (ex: age and residency restrictions); and Compliance with applicable rules and regulations governing the promotion and all prizes offered (ex: registration and obtaining necessary regulatory approvals).
Required Content:
Promotions on B Plan must include the following: A complete release of B Plan by each entrant or participant; and acknowledgement that the promotion is in no way sponsored, endorsed, administered by or associated with B Plan.
Administration of a Promotion:
Promotions may be administered on Pages, Groups, Events, or within apps on B Plan. Personal Timelines and friend connections must not be used to administer promotions (ex: “share on your Timeline to enter” or “share on your friend's Timeline to get additional entries”, and "tag your friends in this post to enter" are not permitted).
Assisting Promotions:
B Plan will not assist you in the administration of your promotion, and you agree that if you use our service to administer your promotion, you do so at your own risk.
5. Collection of Data on Pages, Groups, and Events
Collecting Data from Users:
If you collect content and information directly from users, your Page, Group, or Event must make it clear that you (and not B Plan) are collecting it, and must provide notice about and obtain user consent for your use of the content and information that you collect. Regardless of how you obtain content and information from users, you are responsible for securing all necessary permissions to reuse their content and information.
Automated Collection of Data
Your Page, Group, or Event must not collect users' content or information, or otherwise access B Plan, using automated means (such as harvesting bots, robots, spiders, or scrapers) without written permission from B Plan.
Calls to Action
Your Page, Group, or Event cannot use information obtained from a person’s interaction with your Page's call-to-action button for any purpose other than to provide the service associated with the call-to-action button. If you want to use this information for any other purpose, first obtain a person’s explicit consent.
Processing of Data for Page Insights in the EEA
Where you are in the EEA, the processing of data for Page Insights may be subject to the Page Insights Controller Addendum Page Insights Controller Addendum, which forms part of this Pages, Groups, and Events Policy.
6. Pages-Specific Policies
Page Names:
Page names must not include profanity, excessively incorrect grammar or punctuation, and must not consist solely of generic terms or locations.
Content Visibility:
Content posted to a Page is public and can be viewed by everyone who can see the Page.
Cover Photos and Profile Pictures:
Your Page's cover photo or profile picture must not include a verified checkmark, and also must not include third-party products, brands or sponsors.
Onlines Pharmacies:
Pages must not promote the sale of prescription pharmaceuticals. Pages for online pharmacies may be permitted with B Plan's prior approval.
Age Gating:
You must restrict access by age by communicating it in your group’s description as necessary to comply with applicable laws and regulations.
Post Preview:
When sharing a third party link from your Page, you must not edit any elements of the post preview.
Upload Functionality:
You must not misuse B Plan's upload functionality in connection with your Page.
Name Change and Merges:
Name changes and merges must not result in a misleading or unintended connection and must not substantially change the Page’s subject matter.
Regulated Goods or Services:
Pages promoting the sale of regulated goods or services must comply with our Community Standards.
Traffic Diversion:
You must not accept anything of value to drive traffic to an app or site that engages in traffic arbitrage, or one that contains a disproportionate volume of ads relative to content, or content that is highly sexual, shocking, clickbait, or promotes scams.
Sharing Content:
Content you post to your Page may be reshared by other admins of the Page to other B Plan Products connected to the Page.
Limited Originality of Content:
Pages must not post or share content that primarily consists of minimal original content.
7. Branded Content on Pages
Branded Content:
Branded content must comply with the B Plan Branded Content Policies.
Necessary Disclosures:
Your Page must include all necessary disclosures to people using B Plan, such as any disclosures needed to indicate the commercial nature of content posted by you.
8. Events-Specific Policies
Automated Events:
Events cannot use automated means to generate event invites.
Cost Disclosures:
Events must provide clear and up-front disclosure for any actions or additional costs associated with an event ticket purchase.
Misleading Event Changes:
Changes to an event must not result in a misleading or unintended connection and must not substantially change the event.

Prohibited business practices
B Plan Live must not be used to mislead users to think that specific footage is occurring in real time when it is not.

Inaccurate location
B Plan Live must not be used to mislead users to think that specific footage is happening in a particular locale when it is not.
Example:

Misrepresenting footage from a different country as footage from the Czech Republic
Pre-recorded content
All pre-recorded content contained in a broadcast streamed to B Plan Live must be clearly marked as pre-recorded. For broadcasts that contain a mixture of live footage and pre-recorded footage, only the pre-recorded footage must be marked as pre-recorded.

Looping or static content
B Plan Live should not be used to broadcast looping videos, static images or poll-only videos.

Services
We provide ways for you to communicate with other users of B Plan messaging services through messages, voice, video calls and video chats, sending images and video, and sharing your location with others when you choose.
Price
We charge a monthly fee for using our messaging services, with a 14 days trial period included. All users of our messaging services are responsible for mobile network data plans, Internet access fees, and other fees and taxes associated with use of our services.
Duration, renewal and termination
You can stop using our messaging services at any time for any reason by deleting your account. We may modify, suspend or terminate your access to or use of our services for the reasons described in the B Plan Terms of Service.
Features for end users with disabilities
Our Services are compatible with mobile and desktop accessibility functionality, including the ability to adjust various on-screen contrast by the Dark Mode feature.
