SUMMARY:

* We are a private & secure social network of positive minded people. Here, your privacy is highly respected on all levels. This website runs on a secure server protected on all possible levels with the world's most efficient and most expensive protection tools available.

* This Terms & Conditions is based on private law, private agreement, between private living people (men and women)

* This website is part of a private law-based society called "PrivateSociety", the common private agreement between private people, and as such, it accepts its "Common Minimum Values Declaration", that is about the preference of life, health, positivity, happy mindset and awareness intelligence that we call responsible happiness. (Below you may read about these values in details.)

* We do NOT analyse your data or content, including posts, messages or any personal behaviour on the website;

* We do NOT give your personal data or any analysis of your personal data to a third party (like advertizers);

* Your content stay your content; we do NOT require to provides us the rights to use them outside this social network.

* We expect you to share information and share positivity; otherwise we may ban you.

* To sustain our website and protection system we need a tiny contribution from you in a form of a monthly fee.

We build technologies and services that enable people to connect with each other, build communities and grow businesses. These Terms of Service (the "Terms") govern your use of the brand B Plan and B Plan mobile applications, services, technologies, and software we offer (the SPSG Products or Products), except where we expressly state that separate terms (and not these) apply. These Products (SPSG Products or Products) are provided by Sustainable Private Societies’ Guardian s.r.o. (also referred here as SPSG, SPSG s.r.o).

 

We charge you to use B Plan or the other products and services covered by these Terms - unless we state otherwise – so that we can avoid businesses, organisations and other persons pay us to show you ads for their products and services. Our products and services enable you to connect with your friends and communities. We do not personalise content and we do not show ads that we think may be relevant to you and your interests. You acknowledge that by using or registering to our Products. We do not use your personal data to help determine which personalised ads to show you. When we show advertisement to support our partners, we show it to every user, no matter their activity or preferences they show in the Products.

We don't sell your personal data to advertisers, and we don't share information that directly identifies you (such as your name, email address or other contact information) with advertisers. Advertisers can not tell us things such as the kind of audience that they want to see their ads, and we do not show those ads to people who may be interested, but we show it for all. We do not provide advertisers with reports about the performance of their ads that help them understand how people are interacting with their content.

Our Privacy Policy explains how we collect and use your personal data. You can also go to your Profile Settings pages of the relevant SPSG Product at any time to review your data.

 

 

 

1. The services we provide

Our mission is to give people the power to build community and bring the world closer together in a private and secure manner. To help advance this mission, we provide the products and services described below to you:

  • Provide a community experience for you and your community: Your experience on B Plan is just like anyone else's: from the Posts, Stories, events, ads and other content that you see in B Plan News Feed or our video platform to the B Plan Pages that you follow and other features you might use, such as B Plan Marketplace and search. For example, we do not collect data about the connections you make, the choices and settings you select and what you share and do on and off our Products to personalise your experience.

  • Connect you with people and organisations that you care about: We provide you the opportunity to find and connect with people, groups, businesses, organisations and others that matter to you across the SPSG Products you use. At the same time we do not use data to make suggestions for you and others – for example, groups to join, events to attend, B Plan Pages to follow or send a message to, shows to watch and people you may want to become friends with. We do not bother you with that, you have the right to search and select them for yourself. Stronger ties made on our private and secure platform make for better communities, and we believe that our services are most useful when people are connected to people, groups and organisations that they willinly choose to care about, without any intentional influences from a computer/ software system. We prefer human bonds to be established between humans and we consider our system to be a supporter of that.

  • Empower you to express yourself and communicate about what matters to you and your community: There are many ways to express yourself on B Plan to communicate with friends, family and others about what matters to you – for example, sharing updates about yoursel and your community, photos, videos and stories across the SPSG Products (consistent with your settings), sending messages/ chats or making voice or video calls to a friend or several people, creating events or groups, or adding content to your profile, as well as providing opportunities for others to engage with your content.

  • Help you discover content, products and services that may interest you and your community: We do not show you personalised ads, offers and other sponsored or commercial content in order to not to influence you in the process of searching and discovering content, products and services that are offered by the many businesses and organisations that use B Plan and other SPSG Products.

  • Promote the safety, security and integrity of our services, combat harmful conduct and keep our community of users safe: People will only build community on SPSG Products if they feel safe and secure. We work hard to maintain the security (including the availability, authenticity, integrity and confidentiality) of our Products and services. We pay for dedicated teams around the world, work with external service providers, partners and other relevant entities, and develop advanced technical systems to detect potential misuse of our Products, harmful conduct towards others and situations where we may be able to help support or protect our community, including to respond to user reports of potentially violating content. If we learn of content or conduct like this, we will take appropriate action that may include notifying you, offering help, removing content, removing or restricting access to certain features, disabling an account. Anyway, not as some other social networks, we will not contact law enforcement. We share data with other SPSG departments when we detect misuse or harmful conduct by someone using one of our Products or to help keep SPSG Products, users and the community safe. For example, we share information with SPSG departments that provide financial products and services to help them promote safety, security and integrity and comply with applicable law. SPSG may access, preserve, use and share any information it collects about you where it has a good faith belief that it is required or permitted by law to do so. This is needed for the system and the database to operate. Apart from that we do not analyze your actions within the PSP products. For more information, please review our Privacy Policy.

  • Use and develop advanced technologies to provide safe and functional services for everyone: We use and develop advanced technologies and we develop automated systems to improve our ability to protect our community and our Products. We use server protection and data protection systems that safeguard and secure your data.

  • Research ways to make our services better: We engage in research to develop, test and improve our Products. This includes analysing only the server data users generate (such as processor and RAM requirements, bandwidth requirenments, storage capacity requirenments), and understanding how people use our Products. Our Privacy Policy explains how we use data to support this research for the purposes of developing and improving our services.

  • Provide consistent and seamless experiences across the SPSG Company Products: Our Products help you find and connect with people, groups, businesses, organisations and others that are important to you. We design our systems so that your experience is consistent and seamless across the different SPSG Company Products that you use. For example, the same people and groups you are connected with and the same messages appear in the mobile phone applications as in your web application.

  • Ensuring access to our services: To operate our global services and enable you to connect with people around the world, we need to transfer, store and distribute content and data to our data centres, partners, service providers, vendors and systems around the world, including outside your country of residence. The use of this global infrastructure is necessary and essential to provide our services. This infrastructure may be owned, operated or controlled by SPSG s.r.o., its affiliates or its system development and administration partners.

 

2. How our services are funded

For paying to use B Plan and the other products and services we offer, by using the SPSG Products covered by these Terms, we do not have to show you personalised ads and other commercial and sponsored content that business and organisations pay us to promote on and off the SPSG Company Products. We do not use your personal data, such as information about your activity and interests, to show you personalised ads and sponsored content.

Protecting people's privacy is central to how we've designed our ads system. This means that we can show you relevant and useful ads that are for all – and thereby seen by all -, without telling advertisers who you are. We don't sell your personal data. Advertisers can not tell us things such as their business goal, and the kind of audience that they want to see their ads (for example, people between the ages of 18-35 who like cycling). We only way we show their ad is to show it to everyone.

We also provide advertisers with reports about the performance of their ads to help them understand how people are interacting with their content on and off SPSG Products. For example, we do not provide general demographic and interest information to advertisers, such as the fact that women between the ages of 25 and 34 who live in Madrid and like software engineering have seen an ad. We don't share information that directly identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are).

We do not collect and use your personal data in order to avoid providind targeted services for advertizers. You can learn about how treat and protect your data in our Privacy Policy.

 

3. Your commitments to B Plan and our community

We provide these services to you and others to help advance our mission. In exchange, we need you to make the following commitments:

  1. Who can use B Plan
    When people stand behind their opinions and actions, our community is safer and more accountable. For this reason, you must:

    • Provide for your account the same name that you use in everyday life.

    • Provide accurate information about yourself;

    • Only create one account (your own) and use it for personal purposes.

    • Not share your password, give access to your B Plan account to others or transfer your account to anyone else (without our permission).

    We try to make B Plan broadly available to everyone, but you cannot use B Plan if:

    • You are under 13 years old.

    • You are a convicted sex offender.

    • You have to keep the Community Standards (below)

    • You are part of the network of any secret societies that promote egotism, anger, revenge, pride; or promote the supremacy of worldy wealth; or promote any non-positive physical/ spiritual/ or mental entities or connected teachings; or those organizations which previously or currently practice or perform a fire-, or any kind of offering/ sacraficing of living beings to satisfy their believes; or you are part of any organisations that create preferences about groups of people that is based on their bloodlines or genetics; or you are a part of an organisation or any level of of sub-organization that promote or enhance the establishment of a one world government.

    • We've previously disabled your account for breaches of our Terms, the Community Standards, or terms and policies that apply to your use of B Plan. If we disable your account for a violation of our Terms, the Community Standards or other terms and policies, you agree not to create another account without our permission. Receiving permission to create a new account is provided at our sole discretion, and does not mean or imply that the disciplinary action was wrong or without cause.

    • You are prohibited from receiving our products, services or software under applicable laws.

       

  1. Community Standards
    Every day, people use B Plan to share their experiences, connect with friends and family, and build communities. It’s a service for a lot of people to freely express themselves across countries and cultures and in dozens of languages.

    SPSG recognizes how important it is for B Plan Private & Secure Social Network to be a place where people feel empowered to communicate, and we take our role seriously in keeping abuse off the service. That’s why we developed standards for what is and isn’t allowed on B Plan.

     

    These standards are based on universal values that are formulated in the "Common Minimum Values Declaration" of the "PrivateSociety". To ensure everyone’s voice is valued, we take great care to create standards that can harmonize different views and beliefs. Please read more about it below.

     

    We basically want people to feel home using SPSG Products, therefore we formulated the Community standards, the bridging of which or conducting a behaviour that is not according to it in B Plan Products cause banning the user from the Products.

Please keep in mind that if you do not keep the Community Standards, we can ban you from the Products without paying back any parts/ any amounts of your subscription fee – including the remaining fee of your subscription period -. We are not even obliged to warn you previously. We are not obliged to communicate with you afterwards as well, thus, we do not have to explain our exact reasons of banning your account.

 

 

  1. What you can share and do on SPSG Products
    We want people to use SPSG Products to express themselves and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of our community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):

    • You may not use our Products to do or share anything:

      • That breaches these Terms, the above Community Standards and other terms and policies that apply to your use of our Products.

      • That is unlawful, misleading or fraudulent (or assists someone else in using our Products in such a way).

      • That infringes or violates someone else's rights, including their intellectual property rights (such as by infringing another's copyright or trademark, or distributing or selling counterfeit or pirated goods), unless an exception or limitation applies under applicable law.

    • You may not upload viruses or malicious code, use the services to send spam or do anything else that could disable, overburden, interfere with or impair the proper working, integrity, operation or appearance of our services, systems or Products.

    • You may not access or collect data from our Products using automated means (without our prior permission) or attempt to access data that you do not have permission to access. We also reserve all of our rights against text and data mining.

    • You may not proxy, request or collect Product usernames or passwords, or misappropriate access tokens.

    • You may not sell, license or purchase any data obtained from us or our services.

    • You may not misuse any reporting, flagging, dispute or appeals channel, such as by making fraudulent, duplicative or groundless reports or appeals.

    We can remove or block content that is in breach of these provisions. We can also suspend or disable your account for conduct that violates these provisions, as provided in Section 4.2.

    If we remove content that you have shared for violation of the Community Standards, we'll let you know and explain any options that you have to request another review, unless you seriously or repeatedly violate these Terms or if doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons. For information on account suspension or termination, see Section 4.2 below.

    To help support our community, we encourage you to report content or conduct that you believe breaches your rights (including intellectual property rights) or our terms and policies if this feature exists in your jurisdiction.

    We can also remove or restrict access to content, features, services or information if we determine that doing so is reasonably necessary to avoid or mitigate misuse of our services or adverse legal or regulatory impacts to SPSG.

     

  2. The permissions you give us
    We need certain permissions from you to provide our services:

    • Permission to use content that you create and share: Some content that you share or upload, such as photos or videos, may be protected by intellectual property laws.

      You retain ownership of the intellectual property rights (things such as copyright or trademarks) in any such content that you create and share on B Plan and other SPSG Company Products that you use. Nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want.

      However, to provide our services we need you to give us some legal permissions (known as a "License") to use this content. This is solely for the purposes of providing and improving our Products and services as described in Section 1 above.

      Specifically, when you share, post or upload content that is covered by intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free and worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you share a photo on B Plan, you give us permission to store, copy and share it with others (again, consistent with your settings) such as SPSG Products or service providers that support those products and services. This licence will end when your content is deleted from our systems.

      You can delete individual content that you share, post and upload at any time. In addition, all content posted to your personal account will be deleted if you delete your account (from your Personal Profile menu). Account deletion does not automatically delete content that you post as an admin of a Page or content that you create collectively with other users, such as photos in Shared Albums that may continue to be visible to other album members.

      After you delete your account, your contents are immediately and automatically become deleted. If you send content to the bin, the deletion process is the same. While the deletion process for such content is being undertaken, the content is no longer visible to other users. After the content is deleted, it may take us up to ninety days to remove it from server backups and disaster recovery systems.

      Content will not be deleted within ninety days of the account deletion or content deletion process beginning in the following situations:

      • where your content has been used by others in accordance with this licence and they have not deleted it (in which case this licence will continue to apply until that content is deleted);

      • where deletion within ninety days is not possible due to technical limitations of our systems, in which case, we will complete the deletion as soon as technically feasible; or

      • Where immediate deletion would restrict our ability to:

        • investigate or identify illegal activity or breaches of our Terms and Policies (for example, to identify or investigate misuse of our Products or systems);

        • protect the safety, integrity and security of our Products, systems, services, our employees and users, and to defend ourselves;

        • comply with legal obligations for the preservation of evidence, including data that SPSG Companies providing financial products and services preserve to comply with any record-keeping obligations required by law; or

        • comply with a request of a judicial or administrative authority, law enforcement or a government agency;

      in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis).

      In each of the above cases, this licence will continue until the content has been fully deleted.

    • Permission to use your name, profile picture and information about your actions each other: For example, we may show only to your friends that you are interested in an advertised event or have liked a B Plan Page created by a brand that has paid us to display its ads on B Plan. These internal activity increasing information and content such as this can only be seen by people who have your permission to see the actions that you've taken on SPSG Products.

    • Permission to update software that you use or download: If you download or use our software, you give us permission to download and install updates to the software where available.

     

  3. Limits on using our intellectual property
    If you use content covered by intellectual property rights that we have and make available in our Products (for example, images, designs, videos or sounds we provide that you add to content you create or share on B Plan), we retain all rights to that content (but not yours). You can only use our copyrights or trademarks (or any similar marks) as expressly permitted by our Brand Usage Guideline (that can be requested from the Administrator through the Contact form) or with our prior written permission. You must obtain our written permission (or permission under an open-source licence) to modify, translate, create derivative works of, decompile or reverse-engineer our products or their components, or otherwise attempt to extract source code from us, unless an exception or limitation applies under applicable law or your conduct results banning.

 

4. Additional provisions

  1. Updating our Terms
    We work constantly to improve our services and develop new features to make our Products better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices to promote a safe and secure experience on our Products and services, and/or to comply with applicable law. We will only make any changes if the provisions are no longer appropriate or if they are incomplete, and only if the changes are reasonable and take due account of your interests, or if the changes are required for safety and security purposes or to comply with applicable law.

    We will notify you (for example, by email or through our Products) at least thirty days before we make changes to these Terms and give you an opportunity to review them before they go into effect, unless the changes are required by law. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products.

    We hope that you will continue using our Products, but if you do not agree to our updated Terms and no longer want to be a part of the SPSG community, you can delete your account at any time.

     

  2. Account suspension or termination


    We want B Plan to be a place where people feel welcome and safe to express themselves and share their thoughts and ideas.

    If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies, including, in particular, the Community Standards, we may suspend or permanently disable your access to SPSG Company Products, and we may permanently disable or delete your account. We may also disable or delete your account if you repeatedly infringe other people's intellectual property rights or where we are required to do so for legal reasons.

    We may disable or delete your account if, after registration, your account is not confirmed, your account is unused and remains inactive for an extended period of time or if we detect that someone may have used it without your permission and we are unable to confirm your ownership of the account.

    Where we take such action, we'll let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.

    You may contact us through the Contact form or the Support email of support @ b-plan.club if your account has been disabled and how to contact us if you think that we have disabled your account by mistake.

    If you delete or we disable or delete your account, these Terms shall terminate as an agreement between you and us, but the following provisions will remain in place: 3.3.1, 4.2-4.5.

     

  3. Account deletion due to expiry
    Another aspect from which your account may be deleted is due to subscription renewal exiry periods. To understand the reason, we shall share the information, that the registration of each and every new user into the B-Plan system requires new server resources/capacities to add. This happens automatically. This costs money for us, as hard disk storage capacity (of videos, pictures) and server memory capacity of using a server has a user-count dependent cost. This cost is covered by your subscription fee, as an average fee we calculated to cover the total operating costs. In case you do not subscribe to any of the subscription packages (whether you tried the system with the 14-days free trial period or not) we may delete your account in order to save system resources. This happens on the fourtieth day after the 14-days trial or the fourtieth day after the ending day of your last subscription month or the fourtieth day of your day of passive registration (without choosing the fourteen days trial or a subscription package). We send you an email on the fourteenth day of your trial, on the thirtieth day that is spent without subscription, the thirty-ninth day without subsription and on the 40th day without subscription. On the fourtieth day we delete your account. You will not be able to log in anymore, and we will not be able to recover your account. Nevertheless, our system still keeps and stores your data for ninety days due to the reasons eplained in the above section 4.2.

     

  4. Limits on liability
    Nothing in these Terms is intended to exclude or limit our liability for death, personal injury or fraudulent misrepresentation caused by our negligence, or to affect your statutory rights.

    We will exercise professional diligence in providing our Products and services to you and in keeping a safe, secure and error-free environment. Provided that we have acted with professional diligence, we do not accept responsibility for losses not caused by our breach of these Terms or otherwise by our acts; losses that are not reasonably foreseeable by you and us at the time of entering into these Terms; and events beyond our reasonable control.

     

  5. Disputes
    You may report any issue with your use of B Plan service by reporting it to us as by friending and writing to the B Plan Support user on b-plan.club. If your claim is not resolved, you may kindly consider the following.

    If a claim or dispute arises out of or relates to your use of the SPSG Products as a consumer, both you and us agree that you may resolve your individual claim or dispute against us, and we may resolve our claim or dispute against you in any competent Private Court in the country of your main residence that has jurisdiction over your claim or dispute, and the laws of that country will apply without regard to conflict of law provisions.

    If a claim or dispute arises between us that relates to use of the SPSG Products in any other capacity, including, but not limited to, access or use of the SPSG Products for a business or commercial purpose, or that an entity brings on your behalf, you agree that any such claim or dispute must be resolved in a competent Private Court and Private Law will apply to such claim or dispute without regard to conflict of law provisions.

     

  6. Other

    1. These Terms make up the entire agreement between you and SPSG s.r.o. regarding your use of our Products. They supersede any prior agreements.

    2. Some of the Products that we offer are also governed by supplemental Terms. If you use any of these Products, you will be provided with an opportunity to agree to supplemental Terms that will become part of our agreement with you. For instance, if you access or use our Products for commercial or business purposes, such as buying ads, selling products, developing apps, managing a group or Page for your business, or using our measurement services, you must agree to our Commercial Terms (below). If you post or share content containing music, you must comply with our Music Guidelines (below). To the extent that any supplemental Terms conflict with these Terms, the supplemental Terms shall govern to the extent of the conflict.

    3. If any portion of these Terms is found to be unenforceable, the unenforceable portion will be deemed amended to the minimum extent necessary to make it enforceable, and if it can't be made enforceable, then it will be severed and the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.

    4. You will not transfer any of your rights or obligations under these Terms to anyone else without our consent.

    5. You may designate a person (Called a legacy contact) to manage your account if it is memorialised. If you enable it in your settings, only your legacy contact or a person who you have identified in a valid will or similar legal document expressing clear consent to disclose your content to that person upon death or incapacity will be able to seek limited disclosure of information from your account after it is memorialised.

    6. These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition or sale of assets, or by operation of law or otherwise.

    7. We may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life).

    8. We always appreciate your feedback and other suggestions about our products and services. But we may use feedback and other suggestions without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

    9. If the ownership or control of all or part of our Products or their assets changes, this could result in a transfer of your information to the new owner.

 

 

 5. Other Terms and Policies that may apply to you

  • Community Standards (higher up, within this document): These guidelines outline our standards regarding the content that you post to B Plan and your activity on B Plan and other SPSG Products.

  • European Electronic Communications Code (below): regulates electronic communication rules in Europe.

  • Commercial Terms (below): These Terms apply if you also access or use our Products for any commercial or business purpose, including advertising, operating an app on our Platform, using our measurement services, managing a group or a Page for a business, or selling goods or services.

  • Community Payment Terms (below): These Terms apply to payments made on or through SPSG Products.

  • Commerce Policies (below): These guidelines outline the policies that apply when you offer products or services for sale on B Plan, B Plan and WhatsApp.

  • Music Guidelines (below): These guidelines outline the policies that apply if you post or share content containing music on any SPSG Products.

  • Advertising Policies: These policies apply to partners who advertise across the SPSG Products and specify what types of ad content are allowed by partners who advertise across the SPSG Products. This Policy we will share you when we contract for advertizing services.

  • B Plan Pages, Groups & Events Policy (below): These guidelines apply if you create or administer a B Plan Page, group or event, or if you use B Plan to communicate or administer a promotion.

  • SPSG brand resources: These guidelines outline the policies that apply to use of SPSG trademarks, logos and screenshots. In case you wish to apply our brand elements in your communication, please ask from the System Administrator through the Contact form to deliver you the guidelines.

  • Live Policies: These policies apply to all content broadcast to B Plan Live.

  • Messaging services terms relevant for EU, EEA and UK users: terms applicable to the messaging, voice and video calling services included in B Plan Products are listed below as B Plan Messaging Services and above as European Electronic Communications Code in accordance with EU rules.

EUROPEAN ELECTRONIC COMMUNICATIONS CODE

for messaging, voice and video calling services included in SPSG s.r.o (further on referenced as SPS) Products as B Plan Private & Social Network (further on referenced as B Plan).

 

Effective as of 21 December 2020

The European Electronic Communications Code (Directive (EU) 2018/1972) (the "EECC") requires us to provide applicable users with the following information about the electronic communication service that we provide as part of B Plan's messaging services, including all communication by text, voice and video. This information supplements the terms of service for those services. Applicable users include microenterprises or small enterprises or not-for-profit organisations, unless they have explicitly agreed to waive all or parts of those provisions.

For the purposes of your documentation, future reference and unchanged reproduction, you may download or print a copy of this document.

Our quality of service

We work hard to provide the best service we can. However, we cannot guarantee any minimum levels of quality of service and make no guarantees that our messaging services will always function without disruptions, delay or errors. A number of factors beyond our control may also affect your experience in using our messaging services, and may result in the disruption of your communication with other users, including but not limited to: your local network, firewall, your Internet service provider, the public Internet and power supply.

Price

We do not charge for using our messaging services, as this is the only way for us to finance the costs of the secure server and security services connected to the system. We charge a monthly fee that amounts circa 1 USD and varies based on the package you choose – 1 month, 3 months, 6 months or 12 months payment -. The higher the subscription period, the lower the price. You may also choose to try the services we provide free of charge for 14 days, and only choose a subscription package if you are satisfied with it.

All users of our messaging services are responsible for mobile network data plans, Internet access fees, and other fees and taxes associated with use of our services.

Duration

Our users can terminate their relationship with our service at any time for any reason by deleting their account. We may modify, suspend or terminate your access to or use of our messaging services for the reasons described further below in this Terms of Service.

The security we provide on our messaging services

We work to protect the safety, security and integrity of our messaging services by appropriately dealing with abusive people and activity violating our Terms of Service. We work to prohibit misuse of our service, including harmful conduct towards others. We operate systems to improve our ability to detect incidents, threats or vulnerabilities that may harm the security of our service. If we learn of activity like this, we will take appropriate action, such as removing that activity or contacting law enforcement.

We particularily take steps not to provide data from within our social network to search engines.

Data provided by you

When you sign up for our messaging service, we ask you to provide your name, date of birth (so that we may provide the right B Plan experience for your age), gender (optional), email address or mobile number. You may provide a username and a password and optionally choose from user categories.

The B Plan Data Policy includes information on the personal data that is collected in the context of providing the B Plan messaging / chat services.

Features for end users with disabilities

Our messaging services are compatible with the B Plan network’s visibility setting of Dark Mode, that provides a significant (black and white) contrast for the disabled.

You can take legal action against us for any claim that arises out of, or relates to, our messaging or chatting services. For information on which governing law and venue applies to your claim, please refer to the Disputes section of the B Plan Terms of Service.

Lastly, you may be entitled to refer disputes in relation to matters covered by the EECC to an independent body for dispute resolution appointed in your country. You cannot access emergency services through our messaging/ chat services

There are important differences between our services and your mobile phone and a fixed-line telephone and SMS services. Our services do not provide access to emergency services or emergency services providers, including the police, fire departments or hospitals, or otherwise connect to public safety answering points. You should ensure that you can contact your relevant emergency services providers through a mobile phone, a fixed-line telephone or another service.

B PLAN COMMERCIAL TERMS ("Commercial Terms")

 

These Commercial Terms apply to access or use of the SPSG Products (or "Products"), for a business or commercial purpose (except where we state that separate terms, and not these Commercial Terms, apply to such access or use of a B Plan Product). Business or commercial purposes include using ads, selling products, developing apps, managing a Page, managing a Group for business purposes or using our measurement services regardless of the entity type.

You agree that you will ensure that any third party on whose behalf you access or use any SPSG Product for any business or commercial purpose will abide by the applicable terms of use, including these Commercial Terms, the SPSG Terms of Service ("Terms"), and any applicable supplemental terms, and you represent and warrant that you have the authority to bind that third party to such terms.

As more fully described below, if you reside in the Czech Republic or your business is located in the Czech Republic, these Commercial Terms require the resolution of most disputes between you and us by binding arbitration on an individual basis; class actions and jury trials are not permitted.

  1. Licences: As described in "The permissions you give us" section in our Terms, you grant us a social-network-internal licence to content that is covered by intellectual property rights (e.g. photos or videos) that you share, post or upload on or in connection with our SPSG Products. For any access or use of the SPSG Products, that licence applies to content that you or someone on your behalf (such as your agency or your service provider that manages your Page content for you) makes available on or in connection with any SPSG Product. You will also ensure that you own or have secured all rights necessary to grant the licences and rights that you (or someone on your behalf) grant to us under the Commercial Terms and any applicable supplemental terms, including permission to display, distribute and deliver your content within the SPSG Products.

  2. Compliance with law: You represent and warrant that your access or use of the SPSG Products for business or commercial purposes complies with all applicable laws, rules, and regulations. You further represent that you will restrict access to your content and apps in accordance with all applicable laws, rules and regulations, including geo-filtering or age-gating access or warnings where required. In addition to and without limiting the requirements about who can use the SPSG Products under our Terms, if you are located in a country that is subject to embargo under the laws of the Czech Republic (or under similar laws applicable to you) you may not engage in commercial activities on the SPSG Products unless authorised by applicable laws. If you are on the US Treasury Department's list of Specially Designated Nationals (or an equivalent list), you may not engage in commercial or business activities on the SPSG Products (such as advertising or payments). You are also unable to access or use the SPSG Products if you are prohibited from receiving products, services or software under applicable law.

  3. Data restrictions: You may not send us information prohibited by the supplemental terms or policies. In addition, you may not send to us, or use SPSG Products to collect from people, information that: (i) you know or reasonably should know is from or about children under the age of 13; or (ii) includes health, financial, biometrics or other categories of similarly sensitive information (including any information defined as sensitive under applicable law); except in cases where (a) the terms for that SPSG Product specifically allow it or (b) you are sending financial information for the express purpose of effecting a financial transaction either with us or as enabled by a SPSG Product.

  4. Limits on liability: In addition to and without limiting the scope of the "Limits on liability" section in our Terms, you agree that we are not responsible for the actions, services, content or data of third parties and you release us, our directors, officers, employees and agents from any claims and damages, known or unknown, arising out of or in any way connected with any claim that you have against any such third parties.

    If you are a California resident, you agree to waive California Civil Code Section 1542, which says:

    A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOUR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER, MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.

    Our aggregate liability arising out of or relating to any access or use of the SPSG Products, the Terms (for any access or use of the SPSG Products for business or commercial purposes), or these Commercial Terms will not exceed the greater of one hundred dollars (USD 100) or the amount that you have paid us in the past twelve months.

  5. Disputes:

    1. Third-party claims: If anyone brings a claim, cause of action or dispute against us related to your services, actions, content or information on B Plan or other SPSG Products or your use of any SPSG Products, you agree to indemnify and hold us harmless from and against any damages, losses and expenses of any kind (including reasonable legal fees and costs) related to any such claim, cause of action or dispute.

    2. Commercial claims: Sections 5.c and 5.d below apply to any claim, cause of action or dispute that arises out of or relates to any access or use of the SPSG Products for business or commercial purposes ("Commercial Claim") between you and SPS.

    3. CZ Commercial Claims: If you reside in the Czech Republic or your business is located in the Czech Republic :

      1. You agree to arbitrate Commercial Claims between you and SPSG sro, Inc. This provision does not cover any commercial claims relating to breaches of your or our intellectual property rights, including, but not limited to, copyright infringement, patent infringement, trademark infringement, breaches of the Bran Usage Guidelines, breaches of your or our confidential information or trade secrets, or efforts to interfere with our Products or engage with our Products in unauthorised ways (for example, automated ways). If a Commercial Claim between you and SPSG sro is not subject to arbitration, you agree that the claim must be resolved exclusively on a private contract court of our choice, and that you submit to the personal jurisdiction of any of these courts for the purpose of litigating any such claim.

      2. By entering into this arbitration provision, we and you agree that all parties are waiving their respective rights to a trial by a private jury or to participate in a class or representative action. THE PARTIES AGREE THAT EACH MAY BRING COMMERCIAL CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL PROCEEDING. You may bring a Commercial Claim only on your own behalf and cannot seek relief that would affect other parties. If there is a final judicial determination that any particular Commercial Claim (or a request for particular relief) cannot be arbitrated according to the limitations of this Section 5.c, then only that Commercial Claim (or only that request for relief) may be brought in court. All other Commercial Claims (or requests for relief) will remain subject to this Section 5.c. All issues are for an arbitrator to decide, except that only a court may decide issues relating to the scope or enforceability of this arbitration provision or the interpretation of the prohibition of class and representative actions. If any party intends to seek arbitration of a dispute, that party must provide the other party with notice in writing. This notice of dispute to us must be sent to the following address: SPSG sro, PRAHA 10 - Korunní 2569/108, PSČ 10100, Czech Republic. The arbitration will be governed by the European Court of Arbitration (ECA) according to its Commercial Arbitration Rules, as modified by these Commercial Terms, and will be administered by the ECA. If the ECA is unavailable, the parties will agree to another arbitration provider or the court will appoint a substitute. The arbitrator will not be bound by rulings in other arbitrations in which you are not a party. To the fullest extent permitted by applicable law, any evidentiary submissions made in arbitration will be maintained as confidential in the absence of good cause for its disclosure. The arbitrator's award will be maintained as confidential only to the extent necessary to protect either party's trade secrets or proprietary business information or to comply with a legal requirement mandating confidentiality. Each party will be responsible for paying any ECA filing, administrative and arbitrator fees in accordance with ECA Rules, except that we will pay for your filing, administrative and arbitrator fees if your Commercial Claim for damages does not exceed USD 75,000 and is non-frivolous. If you do not wish to be bound by this provision (including its waiver of class and representative claims), you must notify us as set forth below within 30 days of the first acceptance date of any version of these Commercial Terms containing an arbitration provision. Your notice to us under this Section 5.c must be submitted to the address here: SPSG sro, PRAHA 10 - Korunní 2569/108, PSČ 10100, Czech Republic. All Commercial Claims between us, whether subject to arbitration or not, will be governed by California law, excluding California's conflict of laws rules, except to the extent that California law is contrary to or pre-empted by federal law. If a Commercial Claim between you and us is not subject to arbitration, you agree that the claim must be resolved exclusively a private court of our choice, and that you submit to the private jurisdiction of either of these courts for the purpose of litigating any such claim.

    4. Commercial Claims outside the Czech Republic : If you reside outside the Czech Republic or your business is located outside the Czech Republic, you agree that:

      1. Any Commercial Claim between you and SPSG sro, must be resolved exclusively in a private court of our choice, that you submit to the personal jurisdiction of either of that court for the purpose of litigating any such claim.

      2. Any Commercial Claim between you and SPSG sro must be resolved exclusively in a private court of our choice, that you submit to the private jurisdiction of that court for the purpose of litigating any such claim, that you submit to the personal jurisdiction of either of that court for the purpose of litigating any such claim.

      3. Notwithstanding (i) and (ii) above, any Commercial Claim between you and both SPSG sro, must be resolved exclusively in a private court of our choice, that you submit to the personal jurisdiction of either of that court for the purpose of litigating any such claim.

      4. Without prejudice to the foregoing, you agree that, in our sole discretion, we may also bring any claim we have against you related to efforts to abuse, interfere or engage with our Products in unauthorised ways in the country in which you reside that has jurisdiction over the claim.

    5. Severability: If any provision of this Section 5 is found unenforceable, that provision will be severed and the balance of this Section 5 will remain in full force and effect.

  6. Updates: We may need to update these Commercial Terms from time to time, including to accurately reflect the access or uses of our Products for business or commercial purposes, and so we encourage you to check them regularly for any updates. By continuing any access or use of any SPSG Products for business or commercial purposes after any notice of an update to these Commercial Terms, you agree to be bound by them. Any updates to Section 5 of these Commercial Terms will only apply to disputes that arise after notice of the update takes place. If you do not agree to the updated terms, please stop all access or use of our Products for business or commercial purposes.

  7. Conflicts and supplemental terms: If there is a conflict between these Commercial Terms and the Terms, these Commercial Terms will govern with respect to your access and use of the SPSG Products for business or commercial purposes to the extent of the conflict. Supplemental terms and policies may also apply to your use of certain SPSG Products. To the extent that those supplemental terms conflict with the Commercial Terms, the supplemental terms will govern with respect to your use of those SPSG Products to the extent of the conflict.

    1. If any portion of these Commercial Terms are found to be unenforceable, then (except as otherwise provided) that portion will be severed and the remaining portion will remain in full force and effect.

    2. If we fail to enforce any of these Commercial Terms, it will not be considered a waiver.

    3. Except as permitted in Section 6, any amendment to or waiver of these Commercial Terms must be made in writing and signed by us.

    4. You will not transfer any of your rights or obligations under these Commercial Terms to anyone else without our consent.

    5. These Commercial Terms do not confer any third-party beneficiary rights.

    6. We offer tools to provide transparency and controls to our users about the B Plan experience. Information about you and your use of SPSG Products for commercial or business purposes will not be included in these tools.

    7. You consent that we may disclose your advertising content and B Plan Page posts ("Commercial Content"), and all information associated with such Commercial Content, including information associated with the delivery of that Commercial Content, in response to a valid legal process related to an electoral matter or to a governmental entity or body if SPSG believes that disclosure would assist in a lawful investigation.

    8. Please note that our retention policies for Commercial Content may differ from those set forth in the Terms. We retain Commercial Content as necessary to provide our services to users, for internal record keeping and for product improvement and safety purposes.

    9. All of our rights and obligations under these Commercial Terms are freely assignable by us in connection with a merger, acquisition or sale of assets, or by operation of law or otherwise.

    10. Nothing in these Commercial Terms or any applicable supplemental terms will prevent us from complying with the law.

    11. We reserve all rights not expressly granted to you.

Note: For purposes of these Commercial Terms, references in existing terms or agreements to (i) "the Statement of Rights and Responsibilities", "Statement" or "SRR" will now mean that the SPSG Terms or Terms and (ii) "B Plan" (when used to refer to our products and services) or "B Plan Services" or "Services" will now mean SPSG Products.

B PLAN MUSIC GUIDELINES

These supplemental terms apply if you post or share any videos or other content containing music on any SPSG Products.

 

You are responsible for the content you post

People use our Products to share content with their fans, family and friends. Keep in mind you remain solely responsible for the content that you post, including any music that is featured in that content. Nothing in these terms constitutes any authorization by us with respect to any use of music on any of our Products.

Use of music for commercial or non-personal purposes in particular is prohibited unless you have obtained appropriate licenses. Eligibility for, and participation in, Music Revenue Sharing does not by itself make a video commercial.

 

You may not use videos on our Products to create a music listening experience

We want your fans, family and friend to be able to enjoy your videos. However, if you use videos on our Products to create a music listening experience for yourself or for others, your videos may be blocked and your page, profile or group may be deleted. This includes live videos.

 

Unauthorized content may be removed and you take all (including financial) responsibilities for the charges or damages that non-removal may cause
If you post content that contains music owned by someone else, your content may be reviewed by the applicable rights owner and your content may be blocked, muted or removed if your use of that music is not properly authorized. Otherwise, you agree, that you are responsible for any fines or damages the inproper or unlawful use of content causes to SPSG sro, and in this case you take over any fees, fines or charges that may apply on SPSG sro; you agree to take all connected responsibilities on yourself.

 

The following guidelines can help you plan for your videos:

  • The greater the density of music in a video, the more likely it may be limited (e.g., blocked, muted)

  • Shorter clips of music are recommended

  • There should always be a visual component to your video; recorded audio should not be the primary purpose of the video

B PLAN PAYMENT GUIDELINES

 

1. Making payments

  1. Payment credentials. When you make a payment through the B Plan Products, you agree to provide a valid payment credential. When you have successfully added your payment credential, we will allow you to initiate a transaction using the payments features through the B Plan Products.

  2. Pricing. Pay attention to the details of the transaction, because your total price may include taxes, fees and delivery costs, all of which you are responsible for paying.

  3. Extra terms. You may be presented with additional terms related to a specific payment before you confirm the transaction (such as delivery terms for tangible goods). Those additional terms will also govern that transaction.

  4. Foreign exchange. If your transaction requires a currency exchange, we will use foreign exchange rates provided by one or more external vendors. We aim to upload files from our vendors with the current exchange rates into our system on a daily basis or we simply rely on our payment provider’s exchange rates. However, these processes could be delayed or fail for any number of reasons. If this happens, the foreign exchange rates used will be the ones from the last file received, typically, the ones from the previous day.

  5. Subscriptions. If you purchase a subscription to B Plan, to an app or to a feature within an app, we will bill your payment credential immediately, and then again at the beginning of each subscription period. The following terms apply for subscriptions purchased through payments features through the B Plan Products:

    1. If a free trial period is offered and you do not cancel during the free trial period, you will be billed at the end of the free trial period and at the beginning of each subsequent subscription period.

    2. You can cancel subscriptions at any time on your Account settings page.

    3. If you cancel a subscription, you will still have access to the app or feature that you subscribed to through the end of the subscription period. If an app or feature that you subscribed to becomes unavailable during your subscription, you will not be billed at the beginning of the next subscription period.

  6. No warranties. You acknowledge that any products or services you may purchase are sold by merchants, not by us. WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD ON OR THROUGH THE B PLAN PRODUCTS.

2. Payment methods

  1. Payment credentials. For your convenience, we allow you to fund your transactions using a number of different sources, such as bank cards, and other payment methods.

  2. Authority. When you provide a payment credential to us, you confirm that you are permitted to use that payment credential. When you fund a transaction, you authorise us (and our designated payment processor) to charge the full amount to the payment credential that you designate for the transaction. You also authorise us to collect and store that payment credential, along with other related transaction information. We may also use certain payment card updater services, whose availability varies by issuer, to ensure that we have the most up-to-date information about payment credentials that we store.

  3. Authorisation. If you pay by credit or debit card, we may obtain a pre-approval from the issuer of the card for an amount, which may be as high as the full price of your payment. Your card will be charged at the time that you initiate a payment, or shortly thereafter. If you cancel a transaction before completion, this pre-approval may result in those funds not otherwise being immediately available to you.

  4. Failed payments. If your transaction results in an overdraft or other fee from your bank, you alone are responsible for that fee.

  5. Incompatibility. You may at some point encounter an app or feature that does not support the payment method you would prefer to use; however, you can select a different type of payment instrument (such as credit or debit card, or else).

  6. Refunds. Due to technical limitations, we are able to provide refunds ONLY by making wire transfer into a bank account. If you make a purchase with boleto and later request a refund for any reason, you MUST have a bank account in order to receive the refund. Bank account information provided when requesting a refund should be the same information on the ad account.

  7. Safety. We may delay or limit the availability of your purchase, for either safety reasons, or to make sure that we possess all relevant information necessary to process the payment and deliver to you what you have paid for.

3. Actions we may take

  1. At-will use. We may revoke your eligibility to make payments through the B Plan Products at any time at our sole discretion.

  2. Enquiries. By using payments features through the B Plan Products, you acknowledge and agree that we may make any enquiries that we consider necessary, either directly or through third parties, concerning your identity and creditworthiness.

  3. Our right to cancel. We may cancel any transaction if we believe that the transaction violates these Payments Terms or the Terms & Conditions, or if we believe that doing so may prevent financial loss.

  4. Payment limitations. In order to prevent financial loss to you or to us, we may place a delay on a payment for a period of time, or limit payment credentials for a transaction, or limit your ability to make a payment, or deactivate your account.

  5. Sharing of information. In order to prevent financial loss to you or to us, we may contact your payment credential issuer, law enforcement or affected third parties (including other users) and share details of any payments that you are associated with, if we believe that doing so may prevent financial loss or a violation of law.

  6. Foreign exchange. If your transaction requires a currency exchange, we will use foreign exchange rates provided by one or more external vendors. 4. Disputes and reversals

  1. Customer assistance. Subject to Sections 4.2, 4.3, 4.4, and 4.5 below, we provide various tools in our Support Center (support @ b-plan .club) to assist you in communicating with a third party to resolve a dispute arising from a payment transaction.

  2. No liability for underlying transaction. If you enter into a transaction with a third party and have a dispute over the goods or services that you purchased or over the donation that you made, we have no liability for the goods or services underlying the transaction or for how the third party used your donation. Our only responsibility is to handle your payment transaction. All payments are final unless otherwise required by law. If you order something that becomes unavailable before it can be provided to you, you may request a refund of your payment.

  3. Fraud warning. Use of B Plan Payments to perform fraudulent transactions may result in the loss of funds with no recourse. See Section 6 below for the state specific fraud notices.

  4. Duty to notify us. If you believe that an unauthorised or otherwise problematic transaction has taken place under your account, you agree to notify us immediately, so that we may take action to prevent financial loss. Unless you submit the claim to us within 30 days after the charge, you will have waived, to the fullest extent permitted by law, all claims against us arising out of or otherwise related to the transaction.

  5. Intervention. We may intervene in disputes concerning payments that may arise between you and a developer, but we have no obligation to do so.

  6. Technical difficulties. If you experience a technical failure or interruption of service that causes your payment to fail, you may request that your transaction be completed at a later time.

5. Notices and amendments to these Payments Terms

  1. Notice to you. By using payments features through the B Plan Products, you agree that we may communicate with you electronically any important information regarding your payments or your account. We may also provide notices to you by posting them on our website, or by sending them to an email address or street address that you previously provided to us. Website and email notices shall be considered received by you within 24 hours of the time posted or sent; notices by post shall be considered received within three (3) working days of the time sent.

  2. Notice to us. Except as otherwise stated, you must send notices to us relating to payments through the B Plan Products and these Payments Terms by post to: SPSG sro (B Plan), Attn: Legal Department, PRAHA 10 - Korunní 2569/108, PSČ 10100, Czech Republic.

  3. Amendment guidelines. We may update these Payments Terms at any time without notice as we deem necessary to the full extent permitted by law. The Payments Terms in place at the time that you confirm a transaction will govern that transaction.

6. State notices – Customer complaints and fraud notices

The following provisions apply solely to users of B Plan-Processed Payments:

7. Additional Terms

  1. Terms of Service and conflict of terms. Our Terms of Service ("Terms" or „Terms & Conditions”) apply to your use of payments features through the B Plan Products. In the event of any conflict between these Payments Terms and the Terms, the Payments Terms shall prevail.

  2. Conflict of laws. Some countries may restrict or prohibit your ability to make payments through the B Plan Products. Nothing in these Payments Terms should be read to override or circumvent any such foreign laws.

  3. Courtesy translations. These Payments Terms were written in English (US). To the extent that any translated version of these Payments Terms conflicts with the English version, the English version controls.

  4. Trade sanctions. You must not use payments features through the B Plan Products in connection with activities, individuals or entities that are located in a country or region that is embargoed by the Czech Republic or that would otherwise violate applicable CZ or CZ trade sanctions.

  5. "Us". Without limiting Section 7.1, above, the following are the entities to which "us", "we" or "our" refer: these Payments Terms are between you and B Plan (SPSG sro) (as provided under the Terms).

  6. "B Plan-Processed Payments". As used in these Payments Terms, "B Plan-Processed Payments" refers to payments features where payments are directly facilitated through the B Plan Products by B Plan sro.

B PLAN COMMERCE POLICIES

 

Overview

 

Products sold on B Plan, must comply with our Commerce Policies. Additionally, products sold on B Plan must comply with B Plan's Community Standards. Buyers and sellers are also responsible for complying with all applicable laws and regulations. Failure to comply with our policies may result in a variety of consequences, including, but not limited to, removal of listings and other content, rejection of product tags or suspension or termination of access to any or all B Plan commerce surfaces or features. If you repeatedly post content that violates our policies, we may take additional action on your account. We reserve the right to reject, approve or remove any listing for any reason at any time, at our sole discretion.

 

Steps to take if disapproved

 

Appeal the decision

If your listing has been rejected for violating our Commerce Policies and you feel that it was a mistake, you can request a review by writing to us through the contact form, or these steps for products in your Catalogue, and we'll take another look.

 

Prohibited content

Buying or selling of the following is prohibited on B Plan commerce surfaces and features: any product that is prohibited by the laws of your country. You may only sell products that are not prohibited in the buyer’s country. For this action you take full legal and financial responsibility and take over any fees, fines or charges that may be applied on SPSG sro caused by such inproper action.

Community Standards: Commerce listings must not violate our Community Standards.

Adult products: Listings may not promote the buying, selling or use of adult products.

Alcohol: Listings may not promote the buying or selling of alcohol.

Body parts and fluids: Listings may not promote the buying or selling of human body parts or fluids.

Digital media and electronic devices

Listings may not promote the buying or selling of devices that facilitate or encourage streaming digital content in an unauthorised manner or interfering with the functionality of electronic devices.

Discrimination: Listings must comply with all applicable laws prohibiting discrimination. This includes but is not limited to discrimination for housing listings.

Documents, currency and financial instruments

Listings may not promote the buying or selling of real or fake documents, currency, financial instruments and virtual currency.

Gambling: Listings may not promote the buying, selling or facilitation of online gambling for money or money's worth, including digital currencies. Online gambling includes gaming, betting, lotteries, raffles, casino, fantasy sports, bingo, poker and sweepstakes in an online environment.

Hazardous goods and materials: Listings may not promote the buying or selling of hazardous materials and substances.

Human exploitation and sexual services: Listings may not promote any form of human trafficking, prostitution, escort or sexual services.

Ingestible supplements: Listings may not promote the buying or selling of ingestible supplements.

Jobs

Misleading, violent or hateful: Listings may not contain misleading, violent or hateful products and offers.

No item for sale: Listings may not promote news, humour or other content that does not offer any product for sale.

Prescription products, drugs and drug paraphernalia: Listings may not promote the buying or selling of drugs, drug paraphernalia or prescription products.

Recalled products: Listings may not promote the buying or selling of recalled products.

Sexually positioned products: Listings may not position products or services in a sexually suggestive manner.

You are responsible for ensuring that your Page, Group, or Event complies with all applicable laws, statutes, and regulations.

 

2. General Policies for Pages, Groups, and Events

 

Prohibited Business Practices:

Pages, Groups, and Events must not promote products, services, schemes or offers using deceptive or misleading business practices, including those intended to scam people out of money or personal information.

Impersonation:

Pages, Groups, and Events must not impersonate or falsely represent a brand, entity, or public figure. Where a Page, Group, or Event is being used to express support for or interest in a brand, entity, or public figure, it must make clear in the name or description that it is not an official representation.

Gambling:

Pages, Groups, and Events must not promote online gambling, or gaming where anything of monetary value (including digital currencies) is required to play and anything of monetary value forms part of the prize, without our prior written permission. Common types of gambling or gaming activities which may require permission include betting, lotteries, raffles, casino, fantasy sports, bingo, poker, skill game tournaments and sweepstakes.

Inaccurately Tagged Content:

Pages, Groups, and Events must not inaccurately tag content or encourage users to inaccurately tag content.

Incentivization:

Pages, Groups, and Events must not incentivize people to misuse B Plan features or functionality.

Drug and Alcohol Addiction Treatment

Pages, Groups, and Events must not promote drug and alcohol addiction treatment centers that are misleading, engaging in practices that are harmful to patients, or otherwise violating applicable laws.

 

3. Platform Policy

Apps on Pages, Groups, or Events must comply with the Developer Policies and Platform Terms.

 

4. Promotions on Pages, Groups, and Events

 

Communicating a Promotion:

If you use B Plan to communicate or administer a promotion (ex: a contest or sweepstakes), you are responsible for the lawful operation of that promotion, including: The official rules; Offer terms and eligibility requirements (ex: age and residency restrictions); and Compliance with applicable rules and regulations governing the promotion and all prizes offered (ex: registration and obtaining necessary regulatory approvals).

Required Content:

Promotions on B Plan must include the following: A complete release of B Plan by each entrant or participant; and acknowledgement that the promotion is in no way sponsored, endorsed, administered by or associated with B Plan.

Administration of a Promotion:

Promotions may be administered on Pages, Groups, Events, or within apps on B Plan. Personal Timelines and friend connections must not be used to administer promotions (ex: “share on your Timeline to enter” or “share on your friend's Timeline to get additional entries”, and "tag your friends in this post to enter" are not permitted).

Assisting Promotions:

B Plan will not assist you in the administration of your promotion, and you agree that if you use our service to administer your promotion, you do so at your own risk.

 

 

5. Collection of Data on Pages, Groups, and Events

 

Collecting Data from Users:

If you collect content and information directly from users, your Page, Group, or Event must make it clear that you (and not B Plan) are collecting it, and must provide notice about and obtain user consent for your use of the content and information that you collect. Regardless of how you obtain content and information from users, you are responsible for securing all necessary permissions to reuse their content and information.

 

Automated Collection of Data

Your Page, Group, or Event must not collect users' content or information, or otherwise access B Plan, using automated means (such as harvesting bots, robots, spiders, or scrapers) without written permission from B Plan.

 

Calls to Action

Your Page, Group, or Event cannot use information obtained from a person’s interaction with your Page's call-to-action button for any purpose other than to provide the service associated with the call-to-action button. If you want to use this information for any other purpose, first obtain a person’s explicit consent.

 

Processing of Data for Page Insights in the EEA

Where you are in the EEA, the processing of data for Page Insights may be subject to the Page Insights Controller Addendum Page Insights Controller Addendum, which forms part of this Pages, Groups, and Events Policy.

 

 

6. Pages-Specific Policies

 

Page Names:

Page names must not include profanity, excessively incorrect grammar or punctuation, and must not consist solely of generic terms or locations.

Content Visibility:

Content posted to a Page is public and can be viewed by everyone who can see the Page.

Cover Photos and Profile Pictures:

Your Page's cover photo or profile picture must not include a verified checkmark, and also must not include third-party products, brands or sponsors.

Onlines Pharmacies:

Pages must not promote the sale of prescription pharmaceuticals. Pages for online pharmacies may be permitted with B Plan's prior approval.

Age Gating:

You must restrict access by age by communicating it in your group’s description as necessary to comply with applicable laws and regulations.

Post Preview:

When sharing a third party link from your Page, you must not edit any elements of the post preview.

Upload Functionality:

You must not misuse B Plan's upload functionality in connection with your Page.

Name Change and Merges:

Name changes and merges must not result in a misleading or unintended connection and must not substantially change the Page’s subject matter.

Regulated Goods or Services:

Pages promoting the sale of regulated goods or services must comply with our Community Standards.

Traffic Diversion:

You must not accept anything of value to drive traffic to an app or site that engages in traffic arbitrage, or one that contains a disproportionate volume of ads relative to content, or content that is highly sexual, shocking, clickbait, or promotes scams.

Sharing Content:

Content you post to your Page may be reshared by other admins of the Page to other B Plan Products connected to the Page.

Limited Originality of Content:

Pages must not post or share content that primarily consists of minimal original content.

 

7. Branded Content on Pages

 

Branded Content:

Branded content must comply with the B Plan Branded Content Policies.

Necessary Disclosures:

Your Page must include all necessary disclosures to people using B Plan, such as any disclosures needed to indicate the commercial nature of content posted by you.

 

8. Events-Specific Policies

 

Automated Events:

Events cannot use automated means to generate event invites.

Cost Disclosures:

Events must provide clear and up-front disclosure for any actions or additional costs associated with an event ticket purchase.

Misleading Event Changes:

Changes to an event must not result in a misleading or unintended connection and must not substantially change the event.

All pre-recorded content contained in a broadcast streamed to B Plan Live must be clearly marked as pre-recorded. For broadcasts that contain a mixture of live footage and pre-recorded footage, only the pre-recorded footage must be marked as pre-recorded.

  • Adding a graphic to mark specific footage as pre-recorded

  • Including a disclaimer in the video description or title that specific content is pre-recorded

Looping or static content

B Plan Live should not be used to broadcast looping videos, static images or poll-only videos.

INTRODUCTION

Why did this minimum common values minimum declaration document come into being?

Because our society has reached a level of development - a level of self-cleansing that is necessary at many levels. This fundamentally challenges people's faith in the systemic social order. We all feel and experience that, whether we wish it or not, there is a reassessment, revaluation, paradigm shift in human and social processes and trends. But progress and prosperity can only be built on the concrete foundation of deep human values underneath the surface processes and trends. The common denominator for the development of this minimum human value system is the science of socio-psychology. Using Spiral Dynamics as a method to define this value system, we jointly developed our common value system, version 1.0, by discussing, brainstorming and agreeing on it, on 09 January 2024 in Budapest. This is not dogma. If you have any suggestions for improvement, please let us know and/or participate in a similar value-facilitation meeting. This "Minimum Declaration of Common Values" document will serve as a basis for human and community cooperation.

 

This "Common Minimum Values Declaration" also serves as a private contract. It is based on a declaration that we are alive and therefore prefer life. We do not, as it were, toss a boat at sea according to its law, but walk on the land with our feet planted and live according to the law of the land.

As such human beings, we seek peace. As living human beings, our bodies and spirits are ours alone to dispose of, belong to no one, and our life's accomplishments are not a credit to anyone/anything. In addition, we respect all our inheritance from our ancestors as human beings and have the right to assimilate and/or reassimilate/re-assume it. This "Common Minimum Values" declaration is a contract between the people who accept it, based on our humanity. The decentralized spread of these private law based agreements creates a Private Association of Communities ("Private Association").

 

Basic terms

We need to know what is happening - with alertness intelligence

Our basic human function is to maximize pleasure with the intention of improvement, which we mark with our alertness intelligence (AQ) to the factors that need to be changed. Due to national, social, historical, aptitude, faith, parental/home-schooled and other influencing factors, an individual or a group/community may consider different factors as important both emotionally (EQ) and intellectually (IQ). His or her AQ may also include noticing the cause of these factors. This is manifested in terms of both external (the influences in the world) and internal (the thoughts and emotions that are bubbling up inside us) recognition. What do we do when we recognise an influencing factor? Either we react instinctively - so it controls us and takes us by the nose - or we don't react immediately if we don't want to, but give ourselves the opportunity to analyse the factor that has appeared - so we have the opportunity to control it. We have an intention to improve both external and internal factors, as the effects of parasympathetic and sympathetic processes are genetically encoded in us, so we all (who are sane) strive for the good, the positive, the long term beneficial, to maximise our own, our loved ones, our friends' and others' satisfaction, well-being and happiness.

If we ask ourselves the series question of why we did something, and then why we did it, and so on, we come to the fifth or sixth question.But the desire to maximize individual and communal pleasure is only the right hand of both of our hands. For masculine activity to unfold, wisdom intertwined with femininity is also needed. Even though we know how to make things better, we have to do it at the right time-, place-, with the right inner motivation. The situational awareness is given to us by our Awareness Intelligence (AQ). It is related to the thickness and development of the pre-frontal cortex, which controls the emotions of the limbic system and the impulses of the planetary nerves through intelligent human judgement and thinking. This is responsible for the intelligence of the mind, to be able to pay attention to the important impulses (beyond our Reticular Activation System) that hit us. Once we have noticed something and we can see what is happening in our world and in us, we are able to make it better with good intentions. As long as we are not aware of it, we cannot do that. First see clearly, then act. Mindfulness Intelligence (AQ) helps us do this.

 

We need to improve - with a joyful vision

Nurture, social, historical, aptitude, belief, parental/home-schooled and other influencing factors are therefore secondary to genetic/organic parasympathetic and parasympathetic systems. A parasympathetic mental state can be achieved by a number of physical, social and mental factors. So, we can deal with an issue (even intermittently) within ourselves - mental -, talk to family, friends, acquaintances about it - social/psychological - and physically do things to bring about change.

 

 

The way someone reacts to an impacting factor on them or others is based on the internal patterns of their brain neurons (neuron pathways) through their life experiences. Everyone's neuron network is different. It is shaped by different knowledge, different visual impressions, different subconscious images, different habits, different experiences in relationships or at work. A general preference, thought, emotional, social, cultural, behavioural pattern has emerged from a simmering of these.

 

 

Our individual, group or community values of pleasure (our limbic/parasympathetic need) and our intelligence of alertness (the development of our frontal lobe) are our basic factors for dealing with the world. On top of this, from conception/ birth, we impose/ accumulate our level of values, which evolves as our brain forms. This level of values already determines the way we behave in the world. Our brain neurons give us the answers to our ingrained patterns of what we think about Who? What? Why? How? With whom? When? should be done. "I think the truth here is that ... and we have to think about it this way and that way. So to make this and this happen I will communicate and do this and that." This is the level of values - above our basic functioning.

 

A cooperation or system/organisation can be based on this. Without it, without the cohesion factor, the system that has been built can easily collapse at any time. According to a PWC survey, managers of market-leading companies spend a large part of their time emphasising and communicating their company's values to their employees. Only a values-based system can be used to build an outstanding system of workplace, organisational, community, national activism and active participation, which is then complemented by a necessary set of physical, social and mental well-being elements. Only a system based on such a solid foundation can by itself lead to general well-being at work, organisational, community or national level.

 

 

True development and improvement can only take place through responsible joyfulness

For individual level development we need the following 2 things:

1. recognition of what the current situation is = intelligence of alertness (AQ), which courageously faces and recognises the situation, which may be non-positive; it also includes intelligence accumulated through learning (IQ) and the subsequent wisdom - considered by renowned economists to be the highest form of intelligence - professional intuition or, simply put, intuition.

2. turn it into a positive = joyful vision, which includes, among other things, the positive elements of emotional intelligence (EQ) and traditional logical intelligence (IQ)

 

Together, these two are called responsible joyfulness. Responsible, because it faces the present situation responsibly for the sake of its children and grandchildren; joyful, because it does not seek suffering, but prefers joyfulness, positivity, well-being on both physical and social and mental levels.

 

We apply these two elements continuously in all our development work, combining them as a responsible joyfulness. We can simply say that we use our mind and our heart together, like two trays on a scale, because otherwise what are they for? Too much brain/intellect leads to a lack of emotional intelligence (EQ) - which makes us like the freezer in a Scientologist's fridge - and too much love/compassion/joy-seeking leads to a neglect of intelligence (IQ) - which makes us like a heated fragile, crumbling loaf of butter -. These two pans must therefore be constantly balanced.

 

VALUES - METHODOLOGY

To implement and unfold the strategy of responsible joyfulness set out in the Fundamental Theorems, we need a tangible method that will guide us through the series of physical, social and mental factors, while balancing them to provide a sequence of steps to be taken.

 

 

Our value system is therefore analysed using the science of socio-psychology, the methodology of Spiral Dynamics. We do this because this tool is able, through tens of thousands of surveys, research and books, to classify the values of the individuals who make up society into specific categories. These value categories were not invented by the developers of the method, but were analysed on the basis of tens of thousands of survey questionnaires, and the characteristic patterns and stages of this analysis - which could be observed in every person, group, community and nation - were put on paper. The Spiral Dynamics method of analysis is thus able to determine the values of a given individual or group and to classify them into value-memetic groups. This applies to thought patterns, mindsets, personality types, attitudes, which are also called value systems.

The different Spiral Dynamics colours are in fact levels that build on each other, representing major trends in thinking patterns.

To simplify the lengthy naming/describing of these, they are denoted by colour names. In this way, the mindset of an individual, a group or a society can be broken down into characteristic colour patterns/levels and described in a simplified way.

 

 

Spiral Dynamics can thus be used as a map/ compass for assessing/ analysing/ understanding/ evaluating the values of individuals, groups, communities, organisations and nations in order to better understand them and determine the next steps in their development.

 

 

Progressing through the value ladder ideally leads to ever deepening levels of AQ and, in parallel, to ever higher levels of steady and spontaneous joyful vision.

Understanding each other's values helps to understand more easily the reasons for each other's actions, while also facilitating communication between people. In this way, consensus and harmony based on the same denominator is created.

 

The dark-light/negative-positive side of values and the definition of good/positive

Furthermore, every staircase has a positive side and a sick/ to be repaired/ to be cleaned negative/ dark side. For example, we can use our physical strength to harm others - taking their lives - but we can also use it to help or protect others - defending our country in a combat situation if necessary. The positive side is said to be "good", the negative side is said to be "not good" or recommended to be avoided. The definition of good is also conflated with health processes, the most obvious of which is physical, emotional and mental health, characterised by parasympathetic nervous and organ states and functioning. In addition to the pleasure hormone serotonin, which is released during the unfolding of self-accumulated pleasure (hedonistic), we prefer the unfolding of pleasure accumulated over the long term through communal interests (eudaimonic). This attitude induces the release of dopamine, the "performance hormone", which is released when a task is successfully/perfectly completed, and the release of oxytocin, the "cohesion hormone", which is released when a task is completed in a long term persistent, supportive, loving, compassionate, family (/community/national) way. These two types of pleasure hormones are controlled by our vigilance, by constantly training our vigilance intelligence. In the process, our prefrontal cortex, located under the frontal lobe, develops and thickens. This can keep our emotional waves (our limbic system/"mammalian brain") under control of our intelligence. In addition, our instincts ('reptilian brain') are controlled by the nor-epinephrine neurotransmitter. There is a lot of research on ways to strengthen the prefrontal cortex.

Intelligent control of instincts and emotions is essential for the development of a long-term vision of well-being and joy that benefits all. This alertness intelligence enables the transformation of a given value tendency from negative to positive. What is on my heart should only be my number if I have thought through what I am saying beforehand. The example of physical force is a similar example. This, in itself, is a quality that we apply based on the dark or light nature of our value system in a given area.

According to Spiral Dynamics, the quality of motivation (why we do something) is therefore more important than the act itself. If our motivation is positive, we can easily bring about progress and development by applying responsible joyfulness using the Spiral Dynamics map.

A person's primary goal on the spiral is not progress, but to change negative tendencies into positive ones, to become a human being. The two tools of responsible joyfulness serve precisely this purpose.

 

VALUE LEVELS

 

Value Categories General characteristics

Category staircase

What are these value hierarchy levels? Each memetic level is built on top of the other, like a stable concrete staircase rising from the ground. Each staircase has a simplified name - indicated by a colour - which describes a set of properties for that staircase in one word. As one ascends the staircase, it is not "goodness" or "quality" that increases, but only the main style of thinking, the main preference, that prevails in one's life.

 

If we had not experienced the previous rung of the ladder, our present vision could not have come into being. For example, we could only become a normal adult if we had experienced the teenage period before that.

 

 

The 2 Spiral Dynamics category levels

 

 

The levels analysed by Spiral Dynamics can be categorised as category levels. The first category level indicates locally applied insight and thinking complexity most of the time, the second category level indicates characteristics in global operation-, insight-, proficiency-, caring.

 

Transforming emotions on the spiral

Each of the Spiral Dynamic Levels, like the life of every single human being, is permeated by emotions. Three of the most important of these are displacement, involvement and unawareness. The latter is also the source of the former two. These emotions appear in us in different dynamics towards people or situations with different styles/values/memetics. We need to be able to control/transform/manage these three sets of emotions with our waking intelligence - our prefrontal cortex - in such a way that they do not hold us captive. Instead, we can use them to our advantage - to shape their dynamics in positive ways - for the benefit of ourselves and all of us. Only then can we become truly human.

 

 

I. CATEGORY LEVEL ON THE SPIRAL

1. BEIGE - Archaic-Esthetic Survivor

Archaic instinctual awareness, or the survival level of a born infant. In both cases, the creation of the conditions for existence is important; instinct-, emotions without intellectual control- predominate. Children can only rely on their parents to protect them and ensure their survival; for adults, the focus is on meeting the basic needs of food, shelter and sexuality.

 

Dark BEIGE [recommended to avoid]: narrow-minded, aggressive, selfish, 'if my cow is dead, so is the other's', drug/mind-altering drug/alcohol addict, dislikes you taking his water or food, abusive taker, killer for pleasure and not need, torturer for pleasure, wasteful, hypocritical, lying for survival, deceitful, trap, violent sex act

2. PURPLE - Magical-Animistic Family-Centric

Ancestral Community and the "Italian extended families". They are characterized by listening to the elder members of the family, who are the leaders (chief or head of the family). They believe in nature spirits or deities, magic, sowing and harvesting on certain special days, the magician tells fortunes. When the family gathers, everyone knows their place. All for one, one for all.

In family businesses, key positions are held by family members.

 

Dark PURPLE [suggested to avoid]: not adapting to family/community/nation, over-mystifying, too strong a sense of belonging or family/tribal/national duty, too strong esotericism, gossipy/traitorous, too superstitious, extreme team-obsessed ('just our team', 'just our nation', 'just us ... '), doesn't necessarily like not being a member of family/tribe/nation, divisive when speaking against family/tribe/community member, controversial, subtly 'prickly' with communication, belittling others by hiding behind a joke, fanaticizing for the sake of extended family, outcast/ cliquey, jealous of others' relationships, corrupting relationships from behind

3. RED - Egotistical "Power-God"

The individual breaks free from family ties. The teenager disobeys parents and wants to try out the world of parties and sexuality; the fighter/athlete shows by his outbursts that he is physically the strongest, best able physically. Kings rule by force, subjugating subjects; heroes die martyrs' deaths; RED bosses shout at their subordinates and use the b-word. Sex, power, domination.

Transition to the next memetic level: after a while, the hero gets tired of warfare, constant "hand-holding" and "mind games" and either starts looking for meaning in life or just a way to calculate his income. He begins to impose rules or obey them.

4th BLUE - Law, Order and Justice champion

For the sake of a higher purpose, he gives up some of his egoism for the good of the community, and enters into a hierarchical system that follows the "written" laws of a higher (memetic) being. He fights the battle between good and evil now, for a better future. God, law, democracy, bureaucracy. Corporations are highly hierarchical, regulated.

5. ORANGE - Scientific/Materialistic/Strategic and Effectively Advocating

You want to make money here and now, with great efficiency. He is therefore willing to increase his knowledge and strategy. To do so, he plans and acts strategically as a "smart/strategic RED".

Bright ORANGE [recommended to follow]: Ambitious but not pushy, ambitious, rational, goal-oriented, deliberate, strategic, novelty-seeking, eager to learn and know, science-loving, innovative, creative, successful and making others successful, sharing the 'secret' of success, business-correct and moral, self-reliant and self-made, business share/share-holder, fair in communication too, tells the truth with clear communication for efficiency - "let's not waste each other's time", likes or appreciates you if you don't waste his time and have money or knowledge, strategically courageous (skilled), healthy self-confidence ("I know what you know, but if someone else knows better, let them be right"), hard-working, doesn't trust chance - "a sparrow today is better than none tomorrow" - but if he sees his rational profit then he plans strategically for the long term

6. GREEN - Emotionally Sensitive/ Sustainable Community Lover

We are all equal by nature (quasi, the basic idea of the communist and hippie generation). We can all express our emotions because we care about each other on all levels. The most important thing for us is harmony and we agree until everyone agrees on a decision. We keep the world green/organic/organic in a sustainable way. We eat vitamins and adaptogens, drink smoothies. Green forgets to think a lot of the time thanks to its explosively open heart. It is very passionate about its friends - who are usually also GREEN - but if it goes against its principles, it can become a militant GREEN or a mean green. Although a mean-GREEN is one of the greens, it is not tolerant at all, but fights with anger against all those who are not GREEN. He is not willing/unable to understand that other people may think differently. So, in contrast to the clear GREEN tolerance and acceptance of others, the mean-GREEN is extremely exclusionary, aggressive, hateful, intolerant and in some cases fascist. Because it takes its emotions extremely seriously, it is extremely belligerent. He cannot remain intelligent and diplomatic.

In order to avoid this condition, a strong BLUE and ORANGE memetic is therefore required in the man to keep him healthy as a GREEN. BLUE provides the acceptance and adherence to rules and hierarchy, and ORANGE provides the material conditions for being GREEN.

 

Dark GREEN [suggested to avoid]: indecisive, evil/war-green - "mean-green", all-green - "only green is the right way" (non-acceptance of non-greens), other memetics (non-green, e.g. Sheep-Peace-Green - "only peace is the way and most definitely everyone is well-intentioned", Anti-comparison - "everyone should be accepted no matter what they do", Overly sensitive Crying-Green - "oh you're being contrary again", Health-obsessed, Nature-obsessed, Protesting down-pants and tarisnya-obsessed, exploiting and taking from the community (using its resources), lying if someone is not green because they don't deserve the truth, not loving if love is not all that matters to you (you use your brain as well as your heart) and telling someone to stop, exploitable, fanatically naive ("don't even talk about the negative because it gives off a bad vibe"), daydreaming

 

Bright GREEN [suggested to follow]: Wanting to do something for community and/or environment, positively communal, puts into community without expectation (money, time, energy, bonds, whatever), seeking long-term sustainability and self-sufficiency, not exploiting nature but using it wisely, human relationships are more important to them than any materiality, also caring for his neighbours, community-building, health-conscious, inclusive, scientifically reasoning, accepting previous memetic levels, supporting his decisions with IT systems (speed, necessity of decision), green 'but not the ear', not naive but strategically deliberate, using his brain as well as his heart, able to argue green issues with reason/scientific arguments so that those at previous levels can understand, explicit attention to win-win relationships, self-help/self-sufficient/self-sustaining community associations, direct democracy where the elected leader's decisions can be overruled by the will of the community at any time, importance of understanding and acceptance, protecting the innocent and the downtrodden in the community, telling the truth because all people - whatever their background - have the right to the truth, loving when love is all that matters to you (and using only your heart, not necessarily your brain) and letting everyone do what they want, volunteering, win-win

 

 

Transitioning to the next memetic level: having experienced one's "greenness" in a positive sense, one takes a big step and realizes that one may have necessarily had to go through the previous memetic steps to get to this level, so it might be wiser to accept and understand them as well (which is not so easy for a GREEN to do with ORANGE - or especially with the RED). The thought occurs to him that perhaps he needs the good side of all the previous levels to be able to stay in the GOLD. For example, you need the family bonding/retaining power of PURPLE, the strength-filled perseverance of RED, the secure orderliness of BLUE, and the money-making ability of ORANGE to live in harmony with GREEN.

 

 

CATEGORY 2 LEVELS ON THE SPIRAL

A characteristic of Category Level 2 is the ability to think in terms of several memetics at once in order to match a given topic to people with a given thinking style. It is able to think as any "colour" (not "two-coloured", but multi-coloured) and is able to speak the language of the Category 1 memetic person with whom it is conversing. This also includes the fact that since the average memetic in the world at the moment in civilized regions is between blue and green in terms of its "magnetization point", Category 2 thinkers also manifest themselves in the activities and styles that correspond to these memetics, in the language of the memetic. Category 2-Level therefore means in ordinary terms nothing more than that normal-, "without god-like itch of conspicuousness" people see certain topics in a better way/ in a greater complexity/ context, so that in some cases they solve tasks more easily, while being just like us. They have much deeper mental and psychic processes going on that we don't usually perceive, but because of their Category 2-Sympathetic trait, they manifest in the same way we do.

As an example, a YELLOW occasionally demonstrates as a PIROS that it has physical strength (e.g., because of its "other" qualities). going to the gym with his company mates) and also exemplifies that his mental strength is also a positive heroic one; as a BLUE, he regularly goes to work while developing a healthy democracy there; as a ORANGE, he makes a proper business plan and manages the company's assets profitably; as a GREEN, people love him as a friend while he shares his good ideas on sustainability and healthy eating, supplements and cleanses; as an all-seeing YELLOW, he pulls the strings, creating well-functioning flows, human and material systems.

 

However, it is worth noting that just as Category Level 1 has its positive and negative sides, Category Level 2 is not entirely immune. In any case, it becomes more and more difficult to keep the negative side as one moves up the memetic ladder, as one comes to understand the nature of truth. Thus, although all memetics can be "cultivated" from negative as well as positive motives, the only thing that binds them together and that is certain is that as we sow, so shall we reap.

 

GREEN is followed by the

7. YELLOW - Integrative Systems Thinker

On the one hand, YELLOW sees that people's ways of thinking are different and understands them, because it recognises that it could not have transcended the vision of the GLOBAL and moved to the YELLOW without having walked the memetic stairs. For this reason, he accepts and treats all previous memetic levels with understanding. It does not strive to be different from them, but to be one of them, and even more, to help them to make their daily survival easier.

On the other hand, YELLOW recognises that in the ever-fluctuating and ever-changing world of things, the only certainty is that everything is constantly changing. Nothing is permanent. Neither is our body - its cells change every seven years - nor what we think of as "me".

So the YELLOW becomes a master of the Systems Approach; it simplifies, summarises, looks for trends, encourages synergy and positive feedback, etc., and since it can do nothing else, it puts the change that is already happening of its own accord in its own good service. It signals at the right time when a difficulty is likely to arise - when others are not even thinking about it - it plans three steps ahead, and it takes the time to improvise if necessary, because that is simply the best thing to do.

While people with a Category 1 memetic fear change, YELLOW handles the situation. The Chinese characters that spell the word crisis, 危機, mean both "danger" and "opportunity". This is exactly what YELLOW thinks of it. It catches the snake by the neck, sucks the poison from its teeth and makes medicine out of it.

However, it also recognises that in this changing system, the most important thing is that everyone finds their own best place. SÁRGA, thus, can create a local or even large scale/global system/project. As a Category 2 harmonic of the BESS, it seeks forms and solutions that ensure the basic happiness of beings on a global level.

It sees that progress cannot and should not be forced; everyone should be allowed to thrive at their own level. What can be done to the maximum is that if one asks for help in terms of how to "illuminate"/cleanse issues in their own memetics of negative tendencies, or how to move their life to the next memetic level, then YELLOW is available to help with some good advice. However, a dark YELLOW or even a dark Category 2 attitude is dangerous for both the offender and the sufferer. If someone wants to implement or make implement by force or by serpent nature a system, local arrangement, national or continental processes or system, or even another world order of his own devising, he wants to force his own idea into a spiral that will sooner or later come back to haunt him. People, humanity, must be left alone to evolve within themselves. This is a universal rule. Anyone who breaks it must reckon with the consequences that he himself has "imposed".

 

But the bright YELLOW, stepping up to the first rung of the Category 2 stairs, finds himself in a whole new world. Specifically, because it has become able to see the world with a wider perspective than usual, it is said to have Category 2 memetics. He no longer focuses on himself, but on the entire global community of which he is a member. Whether we talk about "I" or "We" memetics, the Category 2-Sync works for the global community in the first place, using techniques applied individually for "I" memetics and in groups for "We" memetics.

However, there are leaders who, at first sight, one would think show YELLOW qualities, because they easily cross difficult factors, not so easy people, issues, and sometimes behave this way, sometimes that way. They seem to be consciously changing the way they see things.

But if we want to be sure that we are dealing with YELLOW people, we might want to look a little deeper and check if, for example, they have experienced a GREEN vision earlier in life; if they can behave like a GREEN, take vitamins, like being outdoors, advocate organic products, are able to get into situations where everyone is equal.

It's worth checking them out a bit over a period of time and observing how they behave, because it can happen that - if they lose their head and their good manners, if something doesn't happen the way they imagined it - they suffer from narcissistic personality disorder, or they are simply sociopaths - pretending to like people and be nice, when they are secretly only looking out for their own interests, at every moment -. At one moment they may appear to us to have great emotional intelligence, at another they may convince us by their manifestations that they really have none of this noble quality. Moreover, if they also change their emotions very quickly, for example, smiling enthusiastically one minute, becoming draconian angry about an imagined problem the next, then suddenly being nice again, etc., or often pointing at people using the expression "you are to blame", then it is very possible that they may be suffering from bipolar or even borderline personality disorder; they are simply mentally ill. Moreover, we might hope that this is the case we are dealing with, not one of the 3% (or even 10%) of the population of Satanists who put their self-image at the centre of the world.

 

The best indicator of this, apart from the recognition of egoism, is the observation of anger. A true, lucid YELLOW very rarely becomes angry because he understands why people with Category 1 memetic insight think the way they do, understands their motivations, so he also sympathetically understands people's mistakes; whatever happens, he treats people who make mistakes or attack him as a doctor's patient, not as an enemy. Mistakes are usually the result of ignorance, so YELLOW shares information helpfully.

If you find deaf ears-, negative motivation, or an offensive attitude, in that case you will do or complete what needs to be done without any further doubt or concern, or without stepping in the mud yourself-, turn your nose away from the smell of anger and simply move on.

While the Category 1 thinker fights with others (for family, for himself, for justice, for money, for the environment), the Category 2 thinker understands and accepts Category 1 memetic thinkers and defends them from each other, as long as their intentions are well-intentioned.

Anger is akin to putting the brakes on your progress car, or even putting it in reverse. In a moment, anger burns up the good impressions we have accumulated in the past and makes our social relationships with people extremely difficult. Anyone who tries to justify or even glorify anger is promoting a very mistaken idea, since we know the many ill effects of an overactive sympathetic nervous system.

Strength is when one has the inner strength to manage one's inner emotions. Angry people are like crying children with weak inner mental strength - they cannot handle anger within themselves, so they turn their helpless energy outward - unless they are part of the group of people who, according to their books, follow an idealism that explicitly and consciously cultivates it.

It is important to be able to distinguish the opportunistic ORANGE who revert to the RED-BLUE of being yellow from the true YELLOW.

It is not easy, of course, for the YELLOW. By setting up processes in which everyone finds their place, it can create a physically rule-governed community in which everyone is doing their own noble thing. This is not an easy task to achieve - especially when the BLUE-inspired RED rise up against the ORANGE princes and counts, or when the BLUE proletarians attack the ORANGE for the sake of an idealistic GREEN, though intrinsically unworkable, commune vision, as in communism, or when the liberal dark GREEN who have just gone beyond the ORANGE want to tell the conservative BLUE people what the world is really like and how a real human being should behave in it -.

 

Dark YELLOW [recommended to avoid]: knows that he can see through complex situations more easily than others and therefore becomes conceited; uses his own abilities against the interests of others, plays games, influences, manipulates; deceptive, confusing, divisive communication; master of his brain but not of his heart; does not speak up when others make mistakes but leaves them running in circles or makes them do so; does not clarify stable fundamentals but creates real deep value-less and strategy-less operational chaos which inevitably collapses; desire for control and egotistical fame; uses deceptive communication/metacommunication because he knows who to say what to whom, why and how, which he uses to his advantage; builds a large/broad system, but shapes it to serve only his own rejet agenda, speaks the language of the memetic level but exploits the person he is talking to, is unaccepting and has an impatient dislike of you if you are not able to see things as complexly as he does, dominant motivation, cleverly deceptive, master manipulator, professional buffoon (gets caught up in the flow of his work and doesn't see his surroundings/ doesn't care about his surroundings, "don't talk to me until I'm done because I'm making a big thing"), deceptive/manipulative motivation

 

Bright YELLOW [recommended to follow]: Able to think, communicate, act on any memetic level; not only aware of the outside world, but also learning and practicing the art of transforming inner emotions and thoughts; perceptive, masterful with both brain and heart, understanding, patient, forward planning, highly experienced, complex thinker; who lets others think and develop at their own pace; who does not impose his own truth; who can manage and assemble complex systems in which it is not only the system (the brain) but also the person (the heart) that matters; becomes a master of several disciplines in order to help others in their "language", speaks the language of the memetic level with the motivation to help it, doesn't like it if it's not only love that counts for you (you don't just use your heart but your brain too) and you stop someone, especially likes you to see things with a complex mind and to be able to harmonize people of all minds into a team, to be accepting and compassionate no matter how simple or complex your thinking, to be thoughtful, to be a multi-tasker, to be able to put down work no matter how large or complex, to be broad-minded, to be thoughtful/thoughtful with deep knowledge

 

Transitioning to the next memetic level: having perfected his organizational skills, it occurs to SÁRGÁ how great it would be to connect and unite not only the knowledge centres, the forces and people with similar experiences on a global level, but also to create an inner harmony and sense of belonging beyond the external regulated system.

 

 

YELLOW is followed by

8th TURQUOISE - Holistic Global Family, Through the Realisation of the Nature of Reality and the Inner

Some may think that this level is about globalization efforts, but this is only partially true. It can also be manifested in one's life simply by being comfortable in community with other types of people from other countries, as long as they approach it with peaceful goodwill. TURQUOISE can be particularly manifested in the search for truths that can be treated as key values in the mutual harmonization of human life. It identifies values and visions that can make Earth-dwellers part of one big Earth family.

It is worth noting here that TURQUOISE is not merely an idealistic 2nd octave PURPLE who thinks in terms of a global family, but a 2nd Category-Level vision; thus, it can defend itself as PIROS at any time, should the situation require it.

TURQUOISE takes into account natural forces and energies in a similar way to PURPLE, but does so relying on scientific sources. Its vision thus includes what might be considered "mystical" discoveries of science - such as the claims of quantum physics that "reality is relative", "parallel universes exist", "matter can decay and eventually return to space", "it would be nonsense to think that intelligent life exists only in our solar system and only on this small planet called Earth" - statements that, on first hearing (without necessarily feeling the need to study it), are accepted. He expands his world view by relying on the universality of the physical/material world.

Because the TURQUOISE has already experienced the YELLOW, it is able to create global systems as a YELLOW, but leaves the task of solving this to the YELLOWs. For it, it is sufficient to be able to see global trends and to point out development/development directions. Summarising his conclusion in a single sentence, he entrusts its implementation to the YELLOWs, who will put it into practice.

TURQUISE, as the highly knowledgeable family head of a Category 2-LEVEL 2 PURPLE, points the way and then lets the SAGAs unfold their organizing instincts in a global pact for greater security.

The TURQUOISE sees and experiences the emergence of intuition among family/friends, takes it seriously, understands and accepts that it exists. It also starts to test its wings; it starts to test its own intuition, whether it is useful for others/community or not. It talks about (quantum) fields and starts to use field modifiers that can be deployed, e.g. orgonites, 5GBioShield, or "charged" objects.

 

Dark TURQUOISE [recommended to avoid]: 'paradise-out' exclusion of certain groups ("everyone should be happy except ..."); exploring the nature of reality (e.g. through the science of quantum physics) with a non-positive aim, scornful if you are not intuitive (professionally or generally) or envious of you if you are more intuitive

Bright TURQUOISE [suggested to follow]: researching the nature of reality with a positive motive (consuming quantum physics); 'sensing' things, 'feeling' things, intuitive; striving for harmony not only for humanity but for all life; 'seeing through everything' but not saying what you learn unintelligently (respecting others' lives, their private secrets) but keeping it to yourself; striving for others' mental paradise, loving and considering you family if you consider it important to develop your intuition (professional or general)

 

Transition to the next memetic level: the TURQUOISE finds that not only can intuition be passively received as an antenna, but as he sees traces of his thoughts, words and activity appearing in his larger/broader environment, he realizes that everything has an impact on the world. Being active at the CORAL level, the 'Level 2 RED' becomes interested and begins to test it all.

 

The 9th CORAL is followed by the 10th TEAL (2nd S-C BLUE), the 10th GOLD (2nd S-C ORANGE), the 11th LIME (2nd S-C GREEN), which need not be discussed in detail in the context of this document.
